~ <br />It seems to me that Marion County has two choices: <br />A. Under paragraph 9(G), the county can put the Chevron lot to <br />a use other than surface parking, which it will do when we break <br />ground for Courthouse Square August 1, 1997. In this case, <br />Marion County must accept all further responsibility and liabili- <br />ty for environmental remediation. <br />B. Under paragraph 11(E), the county can take over environmen- <br />tal remediation, negotiate a cost estimate for that work, and <br />split the cost with Chevron 1/3 and 2/3. Thereafter, Marion <br />County will assume all further responsibility and liability for <br />environmental remediation. <br />I believe -that option B represents where Kathleen Thorpe of <br />Century West has been taking the county and the basis of her <br />negotiations with representatives of Chevron to date. She has <br />undertaken independent testing and evaluation of the site under <br />pargraph il(B), and she has cooperated with Chevron to enhance <br />its clean up efforts. But the county needs to have and implement <br />a plan for further remediation work if it is to implement the <br />Courthouse Square project without delay. At this point I think <br />Kathleen can use some help to make sure folks don't get in the <br />way her efforts.
