(To be done November <br />11, 1998) <br />Third, I have assembled information concerning the termination of the county's <br />relationship with Dan Berrey. The information includes: <br />1. Copy of Resolution 96-4R exempting contracts related to the development and <br />design of courthouse square from competitive bidding and delegating these to the <br />Department of General Services. <br />2. Copy of Letter of Agreement with Dan Berrey executed by Randy Curtis, Director <br />of General Services 7/31/96. <br />3. Copy of Resolution 96-45R authorizing the Director of General Services to negotiate <br />final contracts for the development and design of courthouse square. <br />4. Copy of the Notice of Mediation Session held May 29, 1997. <br />Copy of Settlement Agreement with Dan Berrey executed June 6, 1997. <br />6. Copy of mutual press release dated June 6, 1997. <br />This matter was not brought to the Board of Commissioners formally. Individual <br />commissioners were consulted and informed throughout this matter, which extended from April <br />15, 1997, through June 6, 1997.. The mediation and settlement were authorized by the general <br />delegation of authority to the Director of General Services in the resolutions referenced above and <br />by a resolution of the Board of Commissioners adopted September 21, 1994, which delegated to <br />the Marion County Legal Counsel "...the authority to act on behalf of Marion County....to sign all <br />necessary settlement documents.....the office of Marion County Legal Counsel deems appropriate <br />to adequately represent the interest of Marion County."
