SALEM AREA MASS TRANSIT DISTRICT <br />CONTRACT FOR SERVICES <br />WHEREAS, the Salem Area Mass Transit District, a Municipal Corporation of the State of Oregon, as <br />defined by ORS 267.200, (hereinafter called the "DISTRICT,") as a local public transit operator, has <br />determined that it is in the best interest of the DISTRICT and its riding public to utilize a private <br />nonprofit, IRC Section 501(c)(3), agency transportation provider to deliver ADA Paratransit <br />transportation services; and <br />WHEREAS, to implement the DISTRICT's Americans With Disabilities Act Complimentary Paratransit <br />Plan, (hereinafter called the CherryLift program), the Oregon Housing and Associated Services, <br />(hereinafter referred to as CONTRACTOR), has been selected to enter into a cont;~act with the District <br />to provide ADA Paratransit transportation services as hereinafter set forth; <br />NOW THEREFORE, the parties hereto intending to be legally bound agree and covenant as follows: <br />Section 1.0 BASIC AGREEMENT <br />Oregon Housing and Associated Services, hereinafter called "CONTRACTOR," hereby covenants and <br />agrees to perform certain ADA Paratransit transportation services as hereinafter described for the <br />benefit of the DISTRICT, and in consideration thereof, the DISTRICT agrees to provide subsidy to the <br />CONTRACTOR in accordance with the terms and conditions set forth herein. These services shall be <br />known as the CherryLift, and shall operate through June 30, 199~8 with renewable extensions of no <br />more than one year each. This contract shall commence on , Januarv 2. 1998 and <br />, ~erate throuqh June 30, 1998. <br />The sum of the amounts paid to CONTRACTOR pursuant to this Contract shall not exceed <br />~$~9200;000. ("Guaranteed Maximum Cost") The DISTRICT shall not be obligated to pay <br />CONTRACTOR more than Guaranteed Maximum Cost for all services required to be provided by <br />I CONTRACTOR under this Contract. The amount paid to the Contractor shall be limited to actual <br />expenses incurred and documented by the Contractor. <br />Section 2.0 Scope of Work <br />2.1 Eligibility <br />Participation in the CherryLift Program shall be restricted to individuals with disabilities whose <br />functional abifity prevents them from independently using the DISTRICTs fixed schedule bus services. <br />The CONTRACTOR is responsible for distributing a self-certification forrn to detem~ine each applicants <br />eligibility. Applicants must be notified of an eligibility deteRnination within 21 days after submitting a <br />completed application. Applicants deemed not eligible must be provided with infnrmation regarding <br />their right to an appeal of an eligibility decision. Applicants may be certified as eligible under the <br />applicable federal regulations to use CherryLift under one of the following ADA eligibility categories: <br />105 <br />CHERRYI_IFf AGREEMENT #1296 .LIFT <br />
