CONTRACTOR shall have a plan to evaluate each driver's ability to transport elderly and disabled <br />people. Evaluation methods shall include at least the following; <br />a. Annual observation of each driver's on-the job performance (the supervisor should ride with the <br />driver to observe their driving techniques); and, <br />b. Annual review of each driver's responsibilities and perFonnance. <br />Results of the annual observation and review shall be documented. <br />Drivers must have a driving record which demonstrates adherence to safery in the operation of motor <br />vehicles and adherence to traffic laws and regulations. <br />The CONTRACTOR must attempt to conduct criminal history checks. Criminal convictions which may <br />constitute a threat to property or the safety of others shall disqualify an individual from consideration <br />for employment as a driver. <br />CONTRACTOR is responsible for ensuring that operators in the program practice good hygiene, such <br />as being dressed neatly, clean, and not emit offensive odors. ~ <br />, <br />. Any subcontracts which the Contractor <br />enters into will include the conditions contained above in Section 4.1, and will preserve the District's <br />right to ensure that the specified terms of driver training are adhered to. <br />4.3 Radio Standards <br />CONTRACTOR must provide two-way radio communication equipment for every vehicle to be used in <br />provision of service for the DISTRICT. <br />4.4 Laws, Ordinances, and Regulations <br />It shall be the responsibility of the CONTRACTOR to ensure that service provided and all equipment <br />utilized in connection with this contract are at all times in compliance with all Federal, State, and Local <br />laws, regulations, ordinances, licenses, or inspections. <br />4.5 Claims <br />If, as a result of any operation performed under this contract, a claim(s) is made against the DISTRICT <br />or the CONTRACTOR, the CONTRACTOR must verbally notify the DISTRICT, with a complete and <br />accurate description of the incident, as promptly as possible but not later than 24 hours following the <br />claim. A written notice of such claim(s) must be submitted to the DISTRICT within 36 hours. The <br />DISTRICT shall notify CONTRACTOR of any claim(s) reported directly to the DISTRICT within 48 <br />hours of receipt of the claim(s). <br />4.6 Accidents <br />~ <br />114 <br />CHERRYLIFf CONTRACT AGREEMENT#1296.
