It shall be the obiieation of the Contractor to review the Contract Documents to determine and to noti the Owners and the Architect of ~ discreoancv between buildina codes and regulations of which the Contractor has knowledQe or should be reasonablv able to determine. _ The Contractor shall not violate~ zoninQ• setback or other locational reauiremenis of avnlicable laws, codes and ordinances or of anv recorded covenants of which the Contractor has knowledQe. If the Contractor observes that nortions of the Contract Documents are at variance with analicable laws, statutes, ordinances. buildine codes, rules or reQUlations, the Contractor orom~tlv shall notifv the Owner and Architect in writine and necessarv chanees shall be accomnlished bv anaroariate Modification ' 7.4 If the Contractor, anv of its Subcontractors or~ ~ubsubcontractor performs Work knowing it to be contrary to anv sunlicable laws, statutes, ordinances, building codes, and rules and regulations without sesk rn om~t notice to the Architect and Owner, the Contractor shall assume full eesponsibiliry for such Work and shall bear the attributable ses~s damages. losses, costs and exnenses. 3.8 ALLOWANCES 3.8.1 The Contractor shall include in the Contract Sum all allowances stated in the Contract Documents. Items covered by allowances shall be supplied for such amounts and by such persons or entities as the Owner may direct, but the Contractor shal! not be required to empioy persons or entities against which the Contractor makes reasonable objection. 3.8.2 Unless otherwise provided in the Contract Documents: .1 materials and equipment under an allowance shal( be selected promptly by the Owner to avoid delay in the Work; .2 allowances shall cover the cost to the Contractor bf materials and equipment delivered at the site and all required taxes, less applicable trade discounts; .3 Contractor's costs for unloading and handling at the site, labor, installation cosu, overhead, profit and other expenses contemplated for stated allowance amounts shall be included in the Contract Sum and not in the allowances; .4 whenever costs are more than or less than allowances, the Contract Sum shall be adjusted accordingly by Change Order. The amount of the Change Order shall reflect (1) the difference between actual costs and the allowances under Clause 3.8.2.2 and (2) changes in Contractor's costs under Clause 3.8.23. 3.9 SUPERINTENDENT 3.9.1 The Contractor shall employ a competent superintendent and necessary assistants who shall be in attendance at the Project site during performance of the Work. The superintendent shall represent the Contractor, and communications given to the superintendent shall be as binding as if given to the Contractor. Important communications shall be confirmed in writing.
