PROCEDURES <br />3.3.1 The Contractor shall supervise and direct the Work, <br />using the Contractor's best skill and attention. T'he Contractor <br />shall be solely responsible for and have control over <br />construction means, methods, techniques, sequences and <br />procedures and for coordinating all portions of the Work <br />under the Contract, unless Contract Documents give other <br />specific instructions concerning these matters. <br />3.3.2 The Contractor shall be responsible to the Owner for <br />acts and omissions of the Contractor's employees, <br />Subcontractors and their agents and employees, and other <br />persons performing portions of the Work under a contract <br />with the Contractor. <br />3.3.3 The Contractor shall not be relieved of obligations to <br />performing the Work in accordance with the Contract <br />Documents either by activities or duties of the Architect in <br />the Architect's administration of the Contract, or by tests, <br />inspections or approvals required or performed by persons <br />other than the Contractor. <br />3.3.4 The Contractor shall be responsible for inspection of <br />portions of Work already performed under this Contract to <br />determine that such portions are in proper condition to <br />receive subsequent Work. <br />Insert _ D: 3.3.5 _,~t the earliest aossible time after the <br />commencement of the Work on the Proiect site, the <br />Contractor shall have all ro comers and benchmarks <br />verified or estabiished bv a state-licensed land survevor, shall <br />locate the Proiect on the Proiect site, establishin~ necessarv <br />reference mazks and axes from which the Work accuratelv <br />can _pmeress, shall furnish Architect evidence of such <br />verification and shall report at once ~ errors discovered <br />durin~ the process of such verification. <br />Insert E: .3.6 The Contractor acknowled~es that it is the <br />Contractor's resvonsibiliri to hire all oersonnel for the <br />~rocer and dili ent prosecution of the Work and the <br />Contractor shall use its best efforts to maintain labor aeace <br />for the duration of the Proiect. In the event of a labor disaute, <br />the Contractor shall not be entitled to ~ increase in the <br />Contract Sum. <br />3.4 LABOR AND MATERIALS <br />3.4.1 Unless otherwise provided in the Contract <br />Documenu, the Contractor shall provide and pay for tabor, <br />materials, equipment, tools, construction equipment and <br />machinery, water, heat, utilities, transportation, and other <br />facilities and services necessary for proper execution and <br />completion of the Work, whether temporary or permanent <br />and whether or not incorporated or to be incorporated in the <br />Work. <br />~ <br />3.4.2 The Contractor shall enforce strict discipline and <br />good order among the Conti-actor's employees and other <br />persons carrying out the Conti-act. The Contractor shall not <br />permit employment of unfit persons or persons not skilled in <br />tasks assigned to them. <br />3.5 WARRANTY <br />3.5.1 The Contractor warrants to the Owner and Architect <br />that materials and equipment furnished under the Contract <br />will be of good quality and new unless otherwise required or <br />permitted by the Contract Documents, that the Work will be <br />free from defects not inherent in the quality required or <br />permitted, and that the Work will conform with the <br />requirements of the Contract Documents. Work not <br />conforming to these requirements, including substitutions not <br />properly approved and authorized, ~ ~e ~e~si~e~e~ <br />~est~ve -shall be considered defective. The Contractor's <br />wairac~ty exctudes remedy for damage or defect caused by <br />abuse, modifications not executed by the Contractor, <br />improper or insufficient maintenance, improper operation, or <br />normal wear and tear under normal usage.
