6e <br /> <br />the lowest sign would be only six feet from the existing <br />grade and would be virtually invisible to the traveling <br />public. MCZO 122.020(a) is met. <br /> <br />The subject property is burdened by the BPA power line <br />easement more than any other property at the interchange. <br />The nearness of the transmission towers to the property <br />require a sign to be tall enough to stand out from the towers <br />and still be placed in a location that is visible from the <br />freeway. The location of towers, in combination with the <br />irregular shape of the lot, difference in grade, large sign <br />on the property to the north and mature vegetation along I-5 <br />are extraordinary circumstances that justify the height <br />variance. MCZO 122.020(b) is met. <br /> <br />The sign is a benign structure requiring little maintenance <br />and emitting no pollutants. The taller sign, with its <br />increased visibility, will further the public welfare by <br />allowing freeway users adequate time to change lanes and <br />safely exit the freeway. MCZO 122.020(c) is met. <br /> <br />Leathers, Inc. owns the subject property and has a substan- <br />tial investment in the form of infrastructure and the ongoing <br />businesses. The business cater to the traveling public and <br />the site must be identifiable from I-5. If the proposed sign <br />is not allowed, and the site is not properly identified, the <br />use and enjoyment of the property will be substantially <br />diminished. MCZO 122.020(d) is met. <br /> <br />The sign will have little or no impact on persons working or <br />residing in the area. No residential areas are near the <br />subject site. The sign must meet Marion County Public Works <br />standards regarding site distance. MCZO 122.020(e) is met. <br /> <br />The intent and purpose of the ID zone is to provide for the <br />location of needed highway service commercial facilities at <br />controlled access highways. Well landscaped sites and <br />attractive buildings shall be encouraged. In providing for <br />the location of these facilities it is essential that the <br />principal function of the interchange, carrying of traffic to <br />and from the freeway in a safe an expeditious manner, be <br />preserved. <br /> <br />The proposed sign will allow motorists to identify a needed <br />service and safely exit the freeway to obtain the service. <br />A single 65 foot high sign will adequately identify busi- <br />nesses on the property while maintaining the aesthetics of <br />the interchange.
