The subject property is designated Interchange Development <br />in the MCCP and is zoned ID. The property is located within <br />the Aurora Airport overlay zone. <br /> <br />The subject property is on the southwest corner of the <br />intersection of Interstate 5 (I-5) and Ehlen Road. The <br />property contains a travel plaza consisting of a full service <br />truck and automobile fueling station and a small convenience <br />store. <br /> <br />Property to east consists of an undeveloped ID zoned parcel. <br />Property to the north, across Ehlen Road, is zoned ID and has <br />been approved for a truck stop. Property to the east, across <br />I-5, is zoned ID and contains a recreational vehicle park. <br />Property to the southwest is zoned EFU (EXCLUSIVE FARM USE) <br />and is devoted to farm use. <br /> <br />Applicant requests a variance to allow a 65 foot high sign <br />where a 45 foot high sign is allowed. <br /> <br />The Marion County Planning Division requested coments on the <br />subject proposal from various governmental agencies. <br /> <br />The Marion County Department of Public Works (DPW) provided <br />the following comments: <br /> <br />Public Works has no objection to <br />variance for a 65-foot high where a <br />sign is allowed. <br /> <br />the proposed <br />45-foot high <br /> <br />The proposed sign will need to comply with vision <br />clearance and setback standards. The applicant <br />shall submit a sign plan to Public Works for <br />review and approval before building permits are <br />issued. <br /> <br />The Marion County Buildinq Inspection Division indicates that <br />building permits are required prior to construction. <br /> <br />V. Additional Findings of Fact and Conclusions of Law <br /> <br />Applicant has the burden of proving all applicable standards <br />and criteria are met. <br /> <br />Under MCZO 122.020, the hearings officer may permit and <br />authorize a variance when it appears from the application, <br />and the facts presented at the public hearings, and by <br />investigation: <br /> <br />V 97-4~ORDER - 2 <br />LEATHERS ENTERPRISES, INC. <br /> <br /> <br />
