The Marion County Surveyor has reviewed the applicants,
request and has the following requirements:

"Parcels 10 acres (and less) must be surveyed.

Per ORS 92.050, plat must be submitted for
review.

Checking fee, second mylar fee and recording
fee required.

Plant service report and/or title report must
be submitted at the time of review."

The Tax Department noted that the 1996-97 taxes are paid. No
other contacted agency responded.

Marion County Comprehensive Plan policies for rural residen-
tial areas provide that homesites should be 1.5 acres to 3.0
acres in size. In addition, the AR zone contains a minimum
lot size of 1.5 acres. Both resulting parcels are consistent
with this requirement, and are of sufficient size to comply
with the Ordinance development standards.

Although the proposed partitioning is appropriate, the County
requires that a Declaratory Statement be recorded with the
property deed because the subject property is near a resource
zone. This serves to notify the applicant and subsequent
owners that there are farm or timber operations in the area.
Also, a special dwelling setback of 40 feet should be main-
tained from the south property line of the undeveloped 2.49
acre parcel to further minimize the potential for conflict
with farm or timber uses.

REPORT PREPARED BY: Vicki Kirsher

Craig O. Luedeman
Director-Planning Division
Community Development Department

Date: 1-15-97
