and regulations the Director must condition or deny the applicat-
ion. Any interested person who disagrees with the Director's
decision may request that the application be considered by the
Marion County Hearings Officer after a public hearing. The
applicant may also request a reconsideration (one time only & a
$150 fee) on the basis of new information subject to signing an
extension of the 120 day time limit for review of zoning applica-
tions.

A public hearing is held on appeals subject to the appellant paying
a $150.00 fee. Requests for reconsideration, or consideration by
the Hearings Officer, must be in writing (Appeal Form available
from the Planning Division) and be received in the Marion County
~anning Division, 285 Church Street NE, Room 160, Salem by 4:30
p.m. on J~k~-~k~Y 3~,~9~7. If you have any question about this
application or the decision please call 588-5038 or visit the
County Planning Office at the above address. This decision is
effective J~I~-~RY 31, 1997 unless further consideration is
requested.

FINDINGS AND CONCLUSIONS: The findings and conclusions on which
the Director based his decision are noted below.

The property is designated Rural Residential in the Marion
County Comprehensive Plan. The purpose of this designation
and the corresponding AR (ACREAGE RESIDENTIAL) zone is to
allow for the creation of acreage homesites at a density that
maintains' the character and environmental quality of the
County's rural residential areas.

2 o

The property is located on the northwest corner of Stonefield
Court and Mill Creek Road. It is identified as Lot 7 of Stone
Field Glen Subdivision.

3 °

Properties to the north, east and west are slated for rural
residential development. Land to the south is in farm use and
is zoned EFU (EXCLUSIVE FARM USE).

The applicants propose to divide a 4.99 acre parcel into two
parcels containing 2.5 acres and 2.49 acres each. An existing
dwelling will be situated on the resulting 2.5 acre parcel.

5 o

The Marion County Building Inspection Division reviewed the
partitioning proposal and commented:

"An Existing System Evaluation is required on
all currently developed parcels to insure
there is no conflict between the proposed lot
lines and the existing septic systems, includ-
ing septic replacement areas.

A Site Evaluation approval is required on all
parcels that are proposed for development."
