B. Transportation System Development Charges (TSDCs) and Parks fee will be assessed at the time of <br />application for building permits. <br />C. Utility service extensions originating from within the State Street public right-of-way require utility <br />permits from PW Engineering. <br />Marion County Building Inspection commented: Permit(s) are required to be obtained prior to the development of <br />structure(s) and/or utilities installation on private property. <br /> <br /> Marion County Septic Division commented: <br />Condition of Approval: A site evaluation is required to establish viability/minimum requirements for an Onsite <br />Septic System. <br /> <br /> Marion County Number 1 Fire Department provided information about site development including fire department <br />access and water supply that will be required per the Oregon Fire Code at the time of development. <br /> <br /> All other contacted agencies either failed to comment or stated no comment or no objection to the proposal. <br /> <br />ANALYSIS AND CONCLUSIONS: <br /> <br />8. Per MCC 17.137.050(A) a single-family dwelling or mobile home not in conjunction with farm uses, subject to the <br />criteria and standards in MCC 17.137.060(A) and (B), 17.137.070, and 17.137.100. <br /> <br />1. 17.137.050 shall satisfy the criteria in the applicable subsections below using OAR 660-033-0130. <br /> <br />a. The use will not force a significant change in, or significantly increase the cost of accepted farm or forest <br />practices on surrounding lands devoted to farm or forest use. Land devoted to farm or forest use does not <br />include farm or forest use on lots or parcels upon which a non-farm or non-forest dwelling has been <br />approved and established, in exception areas approved under ORS 197.732, or in an acknowledged urban <br />growth boundary. <br />b. Will Not significantly increase the cost of accepted farm or forest practices on surrounding lands devoted <br />to farm and forest use. <br />c. For purposes of subsection (a) and (b), a determination of forcing a significant change in accepted farm or <br />forest practices on surrounding lands devoted to farm and forest use or a determination of whether the use <br />will significantly increase the cost of accepted farm or forest practices on surrounding lands devoted to <br />farm or forest use requires: <br />i. Identification and description of the surrounding lands, the farm and forest operations on those <br />lands, and the accepted farm practices on each farm operation and the accepted forest practices <br />on each forest operation; <br />ii. An assessment of the individual impacts to each farm and forest practice, and whether the <br />proposed use is likely to have an important influence or effect on any of those practices. This <br />assessment applies practice by practice and farm by farm; and <br />iii. An assessment of whether all identified impacts of the proposed use when considered together <br />could have a significant impact to any farm or forest operation in the surrounding area in a <br />manner that is likely to have an important influence or effect on that operation. <br />iv. For purposes of this subsection, examples of potential impacts for consideration may include but <br />are not limited to traffic, water availability and delivery, introduction of weeds or pests, damage <br />to crops or livestock, litter, trespass, reduction in crop yields, or flooding.
