City of Salem Planning Division commented: <br />A. This property is designated SF (Single-Family) on the Salem Comprehensive Plan Map, and would therefore <br />be zoned RS (Single-Family Residential) upon annexation and subject to the use and development standards <br />of SRC Chapter 511. <br /> <br />1. The “Existing Utility Building” would need to be converted into a residential use (or have permits <br />issued) prior to partitioning to be a compatible use in the RS zone, as the current use would not be <br />permitted on its own lot. <br /> <br />2. For a Single-Family use in the RS zone, the minimum lot standards per Table 511-2 in SRC <br />511.010(b) require a minimum lot area of 4,000 square feet, minimum lot width and street frontage of <br />40 feet, a minimum lot depth of 70 feet (maximum lot depth of 300 percent of the average lot width). <br />a. Both proposed lots appear to meet the minimum lot standards for a Single-Family use. <br /> <br />3. Per Table 511-3 in SRC 511.010(d), buildings and accessory structures greater than four feet in height <br />for a Single-Family use require a minimum 12-foot setback from the street abutting property line. <br />Existing buildings for a Single-Family use also require a minimum three-foot setback from the <br />interior side property line, and a minimum 14-foot setback from the rear property line (minimum 20- <br />foot setback if greater than one-story). <br />a. The existing structure on Lot 1 appears to not be meeting the minimum street setback, and the <br />existing structure on Lot 2 appears to not be meeting the minimum rear setback. However, as <br />the new property lines are not increasing the nonconformity of these existing structures, they <br />would be considered existing nonconforming development subject to SRC 270.010. <br /> <br />B. If additional off-street parking areas are proposed, they would be required to take access from the flag lot <br />accessway and meet the applicable standards of SRC Chapter 806. <br /> <br />C. The subject property is located within the East Salem Sanitary Sewer Service District and Suburban East Salem <br />Water Service District. The applicant shall contact the Suburban East Salem Water Service District to verify <br />water availability. New connections to the sanitary sewer mains within the East Salem Sanitary Sewer Service <br />District will require permits from the City of Salem. Additionally, City Council Policy X-4 requires an <br />annexation agreement for connection these districts where one has not already be en done so. Please submit <br />construction plans for permits to developmentservices@cityofsalem.net. The permits will not be issued until <br />the annexation agreement has been recorded and plans meet City of Salem Standard Construction <br />Specifications. <br />Marion County Number 1 Fire Department provided extensive comments about water availability and required flow, <br />fire apparatus access and clearance, fire safety during construction, premise identification, and no parking signs. The <br />full packet is available at the Planning Department. <br />Marion County Septic commented: We have reviewed the proposal for Partition 26-002 and determined that we have <br />no comment since the property should be connected to city sewer. <br />Marion County Tax Assessor provided comments related to the subject property’s property taxes. <br />Salem-Keizer Public Schools provided comments about the schools servicing the area, school capacity and enrollment, <br />the potential additional capacity the development might create, school infrastructure costs, and potential future <br />construction costs. <br />All other contacted agencies either failed to comment or stated no concern with/objection to the proposal. <br />6. In order to partition land in an RS (Single Family Residential) zone, the standards and criteria in Chapter 16.02.120 of <br />the Marion County Code (MCC) apply: <br />A. Lot Area. The minimum lot area for a single-family dwelling in a subdivision approved after the effective date <br />of the ordinance codified in this title, is 4,000 square feet when located within the Salem/Keizer area urban
