6. Prior to recording the deeds all taxes due must be paid to the Marion County Tax Department (contact the Marion <br />County Tax Department at 503-588-5215 for verification of payments). <br /> <br />APPEAL PROCEDURE: The Marion County Zone Code provide that certain applications be considered first by the <br />County Planning Director. If there is any doubt that the application conforms with adopted land use policies and regula - <br />tions the Director must condition or deny the application. Anyone who disagrees with the Director's decision may request <br />that the application be considered by a Marion County hearings officer after a public hearing. The applicant may also <br />request reconsideration (one time only and a fee of $200) on the basis of new information subject to signing an extension <br />of the 150 day time limit for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for reconsideration, or <br />consideration by a hearings officer, must be in writing (form available from the Planning Division) and received in the <br />Marion County Planning Division, 5155 Silverton Road NE, Salem, by 5:00 p.m. on April 7th, 2026. If you have <br />questions about this decision contact the Planning Division at (503) 588-5038 or at the office. This decision is effective <br />April 8th, 2026, unless further consideration is requested. <br /> <br />FINDINGS AND CONCLUSIONS: Findings and conclusions on which the decision was based are noted below. <br /> <br />1. The subject properties are designated Rural Residential in the Marion County Comprehensive Plan and <br />correspondingly zoned AR (Acreage Residential). The primary intent of the designation is to provide for rural <br />residential development at a density sustainable with rural services. <br /> <br />2. The subject parcels are located on the south side of Aumsville Highway SE approximately one half of a mile west <br />of the three-way intersection of Aumsville Hwy SE, Deer Park Drive SE, and Jospeh Street SE. <br /> <br /> TL 3001 is mostly vacant land with a driveway leading to the parcel adjacent to the south. This parcel was created <br />by partition case P16-025 in 2016 and reflected in Partition Plat Number 2021-83 (PP2021-083). Therefore, the <br />parcel is considered legal for land use purposes. <br />Note: Marion County Planning staff could not find deeds that describe the two parcels created by partition P16- <br />025 and Partition Plat 2021-083. Applicants will need to address this before this property line adjustment can be <br />completed. <br /> <br /> TL 3100 has a 1966 dwelling and related accessory structures. The property has existed in its current <br />configuration since at least 1979 (Reel 156, Page 1546) and is shown on a 1964 survey in a similar configuration <br />(Survey 18362). Therefore, the parcel is considered legal for land use purposes. <br /> <br />3. Adjacent parcels to the west are in the city limits of the City of Salem and are zoned in accordance to Salem’s <br />zoning ordinances. Parcels to the east and north are similarly zoned AR and in use as small acreage residences <br />with some agricultural uses. Further to the north, south and east, the zoning is Special Agriculture (SA). <br /> <br />4. The applicants are proposing to adjust the existing property line between a 2.42-acre parcel and a 0.99-acre parcel <br />to create a 2.37-acre parcel and 1.04-acre parcel. The purpose of the reconfiguration is to allow the 0.99-acre <br />parcel to expand its septic drain field onto the adjacent 2.42-acre parcel. <br /> <br />5. Various agencies were contacted about the proposal and given the opportunity to comment. <br /> <br /> Marion County Surveyors Office commented: <br />1. Properties 10 acres or less must be surveyed per ORS 92.060 (7) and the survey submitted for review. <br />2. Survey checking fee required at the time of review. <br />3. Property line adjustment deed(s) shall be recorded with the Marion County Clerk’s Office. Per ORS 92.190 <br />(4). <br /> <br /> Marion County Septic commented: <br />Specific Condition of Approval: <br />4845 Path Finder Way SE, Salem will need a septic Existing System Evaluation. <br />5502 Juntura Ave SE, Salem will need a septic Inquiry.
