(a) Identification and description of the surrounding lands, the farm and forest operations on those lands, <br />and the accepted farm practices on each farm operation and the accepted forest practices on each forest <br />operation: <br />(b) An assessment of the individual impacts to each farm and forest practice, and whether the proposed use is <br />likely to have an important influence or effect on any of those practices. This assessment applies practice <br />by practice and farm by farm; and <br />(c) An assessment of whether all identified impacts of the proposed use when considered together could have <br />a significant impact to any farm or forest operation in the surrounding area in a manner that is likely to <br />have an important influence or effect on that operation. <br />(d) For purposes of this subsection, examples of potential impacts for consideration may include but are not <br />limited to traffic, water availability and delivery, introduction of weeds or pests, damage to crops or <br />livestock, litter, trespass, reduction in crop yields, or flooding. <br />(e) For purposes of this section, potential impacts to farm and forest practices or the cost of farm and forest <br />practices, impacts relating to the construction or installation of the proposed use shall be deemed part of <br />the use itself for the purpose of conducting a review under this section. <br />(f) In the consideration of potentially mitigating conditions of approval under ORS 215.296(2), the <br />governing body may not impose such a condition upon the owner of the affected farm or forest land or on <br />such land itself, nor compel said owner to accept payment to compensate for the significant changes or <br />significant increases in costs described in this section. <br /> <br />The applicant provided analysis of the above aspects of the farm impacts test, which is summarized here. The <br />proposed structure is primarily intended as a riding arena, and is a type of building that is permitted in agricultural <br />zones. The land surrounding the subject parcel is actively used for a variety of agricultural and residential <br />purposes. To the north and west is the Willamette Valley Vineyards who are currently expanding vineyard <br />plantings. To the east is a property in timber and wheat production. To the south is land in residential use. The <br />expected increase in trips to the property will be from 45 to 70 per day during operations, and will be well <br />accommodated by the existing roadway. This increase in trips will not affect the adjacent farms. The harvest <br />schedules and transport routes for the wheat and grapes produced near by do not overlay with or depend on access <br />points around the subject parcel. There is no indication that any aspect of the proposal will result in a change in <br />accepted farm or forest practices in the area, nor that any aspect could raise the cost of accepted farm of forest <br />practices in the area. The proposal meets the farm impacts test. <br /> <br />2. The use will not significantly increase fire hazard or significantly increase fire suppression costs or <br />significantly increase risks to fire suppression personnel. <br /> <br />The applicant has been in contact with the Turner Fire Department Inspector and will follow all requirements of <br />the fire district. Nothing about the proposed structure and use are unusual for the zone, nor does any aspect <br />present an increased fire hazard. The criterion is met. <br /> <br />3. Adequate fire protection and other rural services are, or will be, available when the use is established. <br /> <br />The subject parcel is served by Turner Fire District and the Marion County Sheriff’s Office. Requirements from <br />the Turner Fire District are included in this decision. The property currently has an 80,000-gallon fire suppression <br />pond. The property currently has a well and septic system. The well produces 360 gallons per minute. Any <br />necessary septic expansion would require permitting through Marion County, but the applicant does not plan to <br />require an additional septic system for the new building. All rural services may be available to accommodate the <br />expansion. The criterion is met. <br /> <br />4. The use will not have a significant adverse impact on watersheds, groundwater, fish and wildlife habitat, soil <br />and slope stability, air and water quality. <br />
