The applicants should contact the Aumsville Fire District to obtain a copy of the District’s Recommended <br />Building Access and Premise Identification regulations and the Marion County Fire Code Applications Guide. <br />Fire District access standards may be more restrictive than County standards. <br /> <br /> <br />APPEAL PROCEDURE: The Marion County Zone Code provide that certain applications be considered first by the <br />County Planning Director. If there is any doubt that the application conforms with adopted land use policies and regula- <br />tions the Director must condition or deny the application. Anyone who disagrees with the Director's decision may request <br />that the application be considered by a Marion County hearings officer after a public hearing. The applicant may also <br />request reconsideration (one time only and a fee of $200) on the basis of new information subject to signing an extension <br />of the 150 day time limit for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for reconsideration, or <br />consideration by a hearings officer, must be in writing (form available from the Planning Division) and received in the <br />Marion County Planning Division, 5155 Silverton Road NE, Salem, by 5:00 p.m. on September 3rd, 2025. This decision is effective <br />September 4th, 2025, unless further consideration is requested. <br /> <br />FINDINGS AND CONCLUSIONS: Findings and conclusions on which the decision was based are noted below. <br /> <br />1. The subject properties are designated Industrial in the Marion County Comprehensive Plan and correspondingly <br />zoned I (Industrial). The primary intent of the designation is to provide areas where existing industrial uses can <br />operate or be replaced with new industrial uses without developing new areas valuable to farming. <br /> <br />2. The subject property is located on the north side of Porter Rd SE, 2,450 feet east of the intersection between <br />Porter Rd SE and West Stayton Rd SE. The subject properties are currently developed with various light <br />industrial uses and include several large buildings dedicated to these operations. The parcels were created in their <br />current configuration as a result of LLA/P02-014 and are considered legal for land use purposes. <br /> <br />3. Adjacent properties include a variety of different uses. Adjacent properties to the north are zoned AR (Acreage <br />Residential) and contain a number of single family residences. In all other directions, the surrounding parcels are <br />zoned EFU (Exclusive Farm Use) and many of these parcels contain commercial farming operations. The one <br />exception are the roughly 76-acres of land owned by Marion County which make up the Aumsville Ponds County <br />Park. <br /> <br />4. The applicants are proposing to eliminate the existing property line between a 3.66-acre parcel and a 23.49-acre <br />parcel and combine them into one parcel of 27.15-acres. <br /> <br />5. Various agencies were contacted about the proposal and given an opportunity to comment. <br /> <br /> Marion County Surveyors Office commented: <br /> <br /> “Other comments specific to this Planning Action: I would encourage the surveyor preparing the new perimeter <br />description for the combined adjusted property carefully review Reel 2035, Page 49, Partition Plat 2004-82, and <br />Reel 4602, Page 285. Since no survey is required, the new deed description will be very important.” <br /> <br />1. No survey required for properties greater than ten acres per ORS 92.060 (8). <br />2. Property line adjustment deed(s) shall be recorded with the Marion County Clerk’s Office. Per ORS <br />92.190 (4). <br /> <br />Marion County Tax Assessor’s Office provided comments about the tax status of the subject parcels. <br /> <br />All other contacted agencies either failed to comment or stated no objection to proposal. <br /> <br />6. The Marion County Subdivision and Partitioning Ordinance does not require a property line adjustment in an I <br />zone to receive land use approval unless the lots were the result of a division of land previously approved by
