E. Transportation System Development Charges (SDCs) will be assessed at the time of application for <br /> building permits. <br /> <br />Marion County Fire District #1 provided comments related to fire access, fire flow and other elements of the <br />application. These comments are available in the casefile and have been provided to the applicant. <br /> <br />Marion County Building Inspection commented: “Permit(s) are required to be obtained prior to development of <br />structures and/or utilities installation on private property. The 2022 Oregon Structural Specialty Code would <br />require the construction documents for the building be prepared by an Oregon registered design professional, such <br />as an architect or engineer.” <br /> <br />The City of Salem Planning Department commented: “The use would be legal non-conforming upon annexation.” <br /> <br />The City of Salem Development Services Division commented: “The subject property is located within the Jan <br />Ree Water Service District and the East Salem Sewer Service District. Water and sewer mains are available in <br />Lancaster Drive NE to serve the development. Any connection to the mains within these districts will require an <br />annexation agreement to be filed with the City of Salem where one has not already been done so, pursuant to <br />Salem City Council Policy X-4A/B. City of Salem permits are required for new connections to these mains for <br />development. Please contain developmentservices@cityofsalem.net to obtain permits for connection to these <br />mains.” <br /> <br />All other contacted agencies either failed to comment or stated no objection to the proposal. <br /> <br />6. All conditional uses are subject to the general criteria in MCC16.40.020, these include: <br /> <br />(a) The use is listed as a conditional use in the zone, or is otherwise identified as a conditional use and is <br />consistent with the intent and purpose of the zone and the provisions that authorized consideration as a <br />conditional use. <br /> <br /> The use falls under SIC 864 for Civic, Social and Fraternal Organizations, and is listed as a conditional <br />use in the RM zone under MCC 16.04.020(E). The criterion is met. <br /> <br />(b) The parcel is suitable for the proposed use considering such factors as size, shape, location, topography, <br />soils, slope stability, drainage and natural features. <br /> <br /> The applicant has provided a site plan showing the proposed development fitting onto the subject parcels <br />and there are no wetlands, geographic slide hazards or other factors impairing this development. The <br />proposed use will work in conjunction with the adjacent Boys & Girls Club. The criterion is met. <br /> <br />(c) The proposed use, as conditioned, will not substantially limit, impair, or preclude the use of surrounding <br />properties for the uses permitted in the applicable zone. <br /> <br /> This parcel is surrounded by the multifamily residential zone, and is directly adjacent to the Boys & Girls <br />Club established in 2020. The proposed center is complementary to the surrounding uses, and will not <br />limit, impair, or preclude surrounding properties from establishing permitted uses. The criterion is met. <br /> <br />(d) The proposed use, as conditioned, will not have a significant adverse effect on air or water quality. <br /> <br /> Air and water quality is not expected to be significantly affected. The criterion is met. <br /> <br />(e) Adequate public and utility facilities and services to serve the use are available or will be made available <br />prior to establishment of the use. <br /> <br /> The subject parcel is served by the Marion County Sheriff’s Office and the Marion County No. 1 Fire <br />District. The parcel is within the City of Salem and the East Salem Service District. The applicant must
