E. The proposed dwelling shall meet the fire protection and hazard reductions as <br />listed in MCC 17.139.070. <br />F. The dwelling shall maintain a special 200-foot setback from all property lines. <br />Accessory structures shall maintain a special 100-foot setback from surrounding <br />properties in farm or timber production. <br />G. The applicant shall provide evidence that the domestic water supply is from a <br />source authorized in accordance with the Water Resources Department's administrative <br />rules for the appropriation of ground water or surface water and not from a Class II <br />stream as defined in the Forest Practices Rules (OAR Chapter 629). <br />H. Prior to issuance of a building or siting permit for a dwelling, approved under the <br />provisions in MCC 17.139.030(A), (B) or (C), on a tract of more than 10 acres in size, the <br />landowner shall plant a sufficient number of trees on the tract to demonstrate that the <br />tract is reasonably expected to meet Department of Forestry stocking requirements at the <br />time specified in Department of Forestry administrative rules. <br />I. All standards contained in MCC 17.139.070 shall be made conditions of approval. <br />J. As an advisory, the applicant should contact the Stayton Fire District to obtain a <br />copy of the District's Recommended Building Access and Premise Identification <br />regulations and the Marion County Fire Code Applications Guide. Fire District access <br />standards may be more restrictive than County standards. <br />8. The proposed conditions of approval are necessary for the public health, safety, and <br />welfare. <br />VII. Recommendation <br />It is hereby found that Applicant has met the burden of proving the applicable standards <br />and criteria for approval of a zone change, comprehensive plan change, and administrative <br />review to change the zone from EFU (Exclusive Farm Use) to FT (Farm Timber) zone; to change <br />the comprehensive plan designation from Primary Agriculture to Farm Timber, and to establish a <br />template test dwelling on 21.67 acre parcel in the EFU (Exclusive Farm Use) zone located at the <br />end of Wagner Lane SE in the 22600 block (T9S; Range 2E; Section 18A; Tax Lot 100). <br />Therefore, the Hearings Officer recommends that the Marion County Board of <br />Commissioners GRANT the Application subject to the following conditions that are necessary <br />for the public health, safety, and welfare: <br />1. Applicant shall obtain all permits required by the Marion County Building <br />Inspection Division. <br />2. Prior to issuance of any building permits, the applicants shall sign and submit a <br />Farm/Forest Declaratory Statement to the Planning Division. This statement shall <br />be recorded by the applicant with the Marion County Clerk after it has been <br />reviewed and signed by the Planning Director. <br />ZC / CP / AR 25-001 — RECOMMENDATION <br />Jerome P.
