ORDINANCE NO. 346 <br /> <br /> MARION COUNTY <br />aN ORDINANCE SETTING FORT ULES AND EGULATIONS <br />USE OF LANDS CONTAINED WITHIN ANY AND ALL DESIGNATED FLOOD PLAINS <br />WITHIN THE CORPORATE L%MITS OF THE CITY OF AUMSVILLE; REPEALING <br />ORDINANCE NO. 229 IN IT'S ENTIRETY, AND DECLARING AN EMERGENCY. <br /> <br /> WHEREAS, on the 18th day of December, 1978, the City of <br />Aumsville adopted Ordinance No. 229 effective March 1, 1979; <br /> <br /> WHEREAS, effective October 1, ~986, the U.S. Congress adopted <br />new federal regulations regarding flood plains and the National <br />Flood Insurance Program; <br /> <br /> WHEREAS, it is necessary for the City of Aumsville to revise <br />Ordinance No. 229 to comply with said changes; <br /> <br /> WHEREAS, the legislature of the State of Oregon has in <br />ORS, Chapter 197 delegated the responsibility to local govern- <br />mental units to adopt regulations designed to promote the public <br />health, safety and general welfare of it's citizens; <br /> <br />NOW, THEREFORE, the City of Aumsville does ordain as follows: <br /> <br />1.1 STATEMENT OF PURPOSE <br /> <br />It is the purpose of this ordinance to promote the public <br />health, safety, and general welfare, and to minimize public <br />and private losses due to flood conditions in specific <br />areas by provisions designed; <br /> <br /> (1) To protect human life and health; <br /> (2) To minimize expenditure of public money and costly <br />flood control projects; <br />(3) To minimize the need for rescue and relief efforts <br />associated with flooding and generally undertaken at the <br />expense of the general public; <br />(4) To minimize prolonged business interruptions; <br />(5) To minimize damage to public facilities and utitites <br />such as water and gas mains, electric, telephone and sewer <br />lines, streets and bridges located in areas of special <br />flood tlazard; <br />(6) TO help maintain a stable tax base Dy providing <br />for the sound use and development of areas of special flood <br />hazard so as to minimize future flood blight areas; <br />(7) To ensure that potential buyers are notified that <br />property is in an area of special flood hazard; and <br />(8) To ensure that those who occupy the areas of special <br />flood hazard assume responsibility for their actions. <br /> <br />Page <br /> <br /> <br />
