by the State of Oregon for the expansion of Highway 22. <br />Development is limited to a single family dwelling, well, and <br />septic system on the 6.06 acre parcel. <br /> <br />Surrounding uses consist of acreage parcels in residential and <br />farm uses. All surrounding properties are zoned for rural <br />residential development. <br /> <br />The Marion County Department of Public Works provided the <br />following remarks regarding this proposal; <br /> <br />"Oregon Department of Transportation (ODOT) is in the <br />process of closing private accesses to North Santiam <br />Highway and purchasing right of way and constructing <br />frontage roads as necessary to enhance the function of <br />the state highway. ODOT has informed Public Works that <br />construction of Kasa Lane is at least one year away <br />leaving the issue of access to the proposed homes in <br />question. Future home builders need be made aware of the <br />time frame for completing Kasa Lane. <br /> <br />Once Kasa Lane is constructed jurisdiction will be turned <br />over to the County. Driveway permits will be required <br />for any new access or change in existing access to the <br />right of way under County jurisdiction. Also, any <br />utility work in the right of way will require a utility <br />permit from Public Works." <br /> <br />The Oregon State Department of Transportation indicate that <br />they are not opposed to the lot line adjustment. Comments <br />dated April 8, 1994 from James Westbrook (District Permit <br />Specialist) state, "This is to inform the County that no <br />access to these parcels, permanent or interim, will be granted <br />to State Highway 22. Access to the highway from these parcels <br />will be via Kasa Lane and the Silver Falls Highway. The <br />existing driveway from Highway 22 will be closed when the <br />Joseph Street to Stayton improvement project is started." The <br />applicant submitted a copy of letter dated April 28, 1994 <br />addressed to him from Wes Smith (Right of Way Agent). The <br />letter states, "You requested from the State a letter indicat- <br />ing present a~d future access to your property. The State <br />will allow the existing access from N. Santiam Hwy to continue <br />until the State constructs a frontage road to access your <br />property. The future frontage road will be an improvement and <br />extension of Kasa Lane to county standards as part Of the <br />Joesph (sic) St - Stayton NCL road construction project. The <br />project is scheduled to be let in the spring of 1995. The <br />State will not close the direct access from your property to <br />N. Santiam Hwy until the new access road is completed." <br /> <br />The Marion County Building Inspection Division commented as <br />follows; <br /> <br /> <br />
