FINDINGS AND CONCLUSIONS: The findings and conclusions on which <br />the Director based h~s decision are noted be[ow. <br /> <br />The subject property is designated Rural. Residential in the <br />Marion County Comprehensive Plam and is zoned RS (SINGLE <br />FAMILY RESIDENTIAL), The primary intent of the ~omprehensive <br />Plan and zone desiqnation is to provide land for rural housing <br />that maintains the ~nvironmental quality and character of the <br />county's rural areas. <br /> <br />Th~ subject property is located on the north side of Lakewood <br />Drive approximately 300 feet from the intarsection of Lakewood <br />Drive and Grim Road. <br /> <br />Properties to the west, north and east are part of a residen- <br />tial subdivision known as Lakewood Estates. Uses to the south <br />are primarily commercial farm activities. <br /> <br />The applicants' are proposing to construct an air-stripping <br />tower and a water treatment system building in order to clean <br />up a contamination problem now existir%g with the Lakewood <br />Estates Water supply system. The applicants are working with <br />the DEQ in an attempt to remove industrial solvents which have <br />been found in the water supply. The treatment facility would <br />be located on a small 20 by 83 foot vacant parcel currently <br />owned by Lakewood Estates. <br /> <br />Section 131.010 of the Marion County zoning ordinance lists <br />permitted uses in an RS zone. That Subsection (f) ststes that <br />public utility structures and buildings such as pump stations <br />and reservoirs, electric substations, .when they comply with <br />all yard and setback requirements are considered permitted <br /> <br />The proposed tower and treatment building would be considered <br />utility structures referred to in section 131.010 (f) and <br />therefore would be considered permitted within the zone. Both <br />structures as shown on the submitted site plan would be <br />capable of being placed in conformance with all required yards <br />an~ setbacks. <br /> <br />Staff report prepared by: Joe Ellis <br /> <br />kfa~ O.
