As a result, the county is responsible <br />for ensuring the requirements of the statutes and <br />administrative rules. <br /> <br />Based on your letter and our recent telephone <br />conversation, you expressed concern over the City of <br />AumsVille setback requirement~ for accessory structures <br />being different than those required by Oregon <br />Administrative Rule (OAR) 918-600-050. <br /> As the <br />manufactured dwelling parks program is a delegate4 <br />program, the setback~ established in administrative rule <br />are ~he only ~equirements which can be enforce~ by the <br />county. Therefore, the City Of Aumsvtlle cannot <br />establish setback requirements different then those of <br />the state. <br /> <br /> In response to your question on definition of accessory <br /> structures, ORs 446.003(1) defines "accessory struoture. <br /> meaning <br />~ . "an~ portable, demountable or <br /> ruc=ure establzsh~ for ........ per~anent <br /> a ~ u~ one occupant of the <br />manufactured dwelling nd which is designed or intended <br />to be attached to and which depends, in whole or in part, <br />upon the manufactured dwelling for structure3 support., <br /> <br /> <br />
