ADDITIONAL CONDITIONS~ Once the approved use is established the <br />following conditions must be continually satisfied= <br /> <br />Materials that are buoyant, flammable, obnoxious, toxic or <br />otherwise injurious to persons or property, if transported by <br />floodwaters, are prohibited. Storage of materials and <br />equipment not having these characteristics is permissible only <br />if the materials and equipment have low-damage potential and <br />are anchored or are readily removable from the area within the <br />time available after forecasting and warning. <br /> <br />OTHER PEllMITS AND RESTRICTIONSz This approval does not remove or <br />affect any covenants or restrictions imposed on the subject <br />property by deed or other instrument. The proposed use may require <br />permits from other local, State or Federal agencies. This decision <br />does not take the place of, or relieve the responsibility for <br />obtaining other permits or satisfying any restrictions or condi- <br />tions thereon. <br /> <br />~R~RE: The Marion County Zoning Ordinance provides that <br />Floodplain/Greenway Development applications be considered first <br />by the County Planning Director. If there is any doubt that the <br />application conforms with adopted land use policies and regulations <br />the Director must condition or deny the application. Any inter- <br />ested person who disagrees with the Director's decision may request <br />that the application be considered by the Marion County Hearings <br />Officer after a public hearing. The applicant may also request <br />reconsideration on the basis of new information subject to signing <br />a waiver of the 120 day time limit for review of zoning applica- <br />tlons. <br /> <br />A public hearing is held on appeals subject to the appellant paying <br />a $25.00 fee. Requests for reconsideration, or consideration by <br />the Hearings Officer, must be in writing and be received in the <br />Marion Count3 Planning Di%ision, 220 High street NE, Salem by 5:00 <br />p.m. on ~ ~. C~ ~ <br /> <br />FJ~NDINGS AND CONCLUSIONS: The findings and conclusions on which <br />the Director based his decision are noted below. <br /> <br />The subject property is designated Primary Agriculture in the <br />Marion County Comprehensive Plan and correspondingly zoned <br />EFU (EXCLUSIVE FARM USE). It is also located with the Mill <br />Creek Floodplain Overlay Zone. <br /> <br />The subject property is located On the southeast corner of the <br />intersection of Mill Creek Road and 70th Avenue. The subject <br />43 acre parcel contains a dwelling and several accessory <br />structures. The majority of the property is in farm use. <br /> <br /> <br />
