Findings of Fact <br /> <br /> The Hearings Officer, after careful consideration of' the <br />testimony and evidence in the record, issues the following <br />findings of fact: <br /> <br />The property is designated Primary Agriculture in the <br />Marion County Comprehensive Plan and is zoned EFU. <br />Agricultural uses are permitted in this zone. The <br />southern half of the subject property ~s within the <br />identified 100 year Floodplain of Mill Creek. <br /> <br />The property is located on the south side of' Mill Creek <br />Road approximately 600 feet west of its intersect:ion <br />with Leverman Road. Findings of Fact and Conclusions of Law <br /> <br />The additional fish ponds are a permitted use and t:he <br />increase in production, up to 32 rs_aping ponds, would be <br />enough to classJfy t,h'i.s Operation as a commercial far'm. <br /> <br />2. The criteria which is r'elevant to this application is <br /> MCZO 278.060. <br /> <br />The issues on appeal deal with the conflicts between the <br />permitted commercial farm operations on EFU land and the <br /> <br />CU/FP 88-8/ORDER - 2 <br /> <br /> <br />
