NOTICE OF DECISION <br />CONDITIONAL USE CASE NO. 87-31}. <br /> <br /> 4ARION COUNTY <br />BUILDING <br /> <br />~ Application of Arnold and Evelyn Selnes to locate a <br />second farm dwelling on a 7+ acre parcel in an EFU (EXCLUSIVE <br />FARM USE) zon~ on property located at 9143 West Stayton Road SE, <br />Aumsville (Sec. 1; T95; R2W). Tax lot #61374-000. <br /> <br />DECISION: Notice is hereby given that the Planning Director for <br />Marion County has APPROVED the above described Conditional Use <br />application subject to certain conditions. <br /> <br />Conditions of approval. <br /> <br />This corLditional use permit is valid only when exercised by <br /> <br />The applicant shall obtain approval for subsurface sewage <br />disposal and all other required permits from the Marion <br />County Building Inspection Division. <br /> <br />The applicant shall submit a Mobile Home Removal Agreement <br />to the Planning Division. This agreement specifies that the <br />mobile home will be removed when the occupants no longer <br />perform a significant amount of work on the farm throughout <br />the year or the farm operation no longer satisfies Condition <br />#6 (agreement enclosed). <br /> <br />No new driveway access points onto public or private roads <br />shall be created to serve the mobile home. <br /> <br />The applicant should contact the Aumsville Fire District and <br />obtain a copy of the District's recommended Building Access <br />and Identification Guidelines. For personal and property <br />safety it is recommended that the applicant follow these <br />guidelines. <br /> <br />If the land in farm use (including owned and leased lands) <br />is reduced below 350 acres at any time in the future, the <br />mobile home shall be removed [rom the premises pursuant to <br />the Removal Agreement. <br /> <br />PROCEDURE: The Marion County Zoning Ordinance provides that <br />certain Conditional Use applications be considered first by the <br />County Planning Director. If there is any doubt that the <br />application conforms with adopted land use policies and regula- <br />tions the Director must condition or deny the application. Any <br />interested person who disagrees with the Director's decision may <br />request that the application be considered by the Marion County <br />Hearings Officer after a public hearing. The applicant may also <br />request reconsideration on the basis of new information subject <br />to signing a waiver of the 120 day time limit for review of <br />zoning applications.
