Materials that are buoyant, flammable, obnoxious, toxic or <br />otherwise injurious to persons or property, if transported by <br />floodwaters, are prohibited from placement in the floodplain. <br />Storage of ma%erials and equipment not having these character- <br />istics is permissible within the floodplain only if the <br />materials and equipment have iow-damage potential and are <br />anchored or are readily removable from the area within the <br />time available after forecasting and warning. <br /> <br />OTHERpERMITS AND R~TRICTIONS: This approval does not remove or <br />affect any covenants or restrictions imposed on the subject <br />property by deed or other instrument. The proposed use may require <br />permits from other local, State or Federal agencies. This decision <br />does not take the place of, or relieve the responsibility for <br />obtaining other permits or satisfying any restrictions or condi- <br />tions thereon. It is recommended that the agencies mentioned in <br />Finding .#5, below be contacted to identify restrictions or <br />necessary permits. The applicant is advised of the following: <br /> <br />The applicant should contact the Aumsville Rural Fire District <br />and obtain a copy of the District's Recommended Building <br />Access and Identification Guidelines. For personal and <br />property safety it is recommended that the applicant follow <br />these guidelines. <br /> <br />PROCEDtF~E= The Marion County Zoning ordinance provides that <br />Floodplain Development applications be considered first by the <br />County Planning Director. If there is any doubt that the applica- <br />tion conforms with adopted land use policies and regulations the <br />Director must condition or deny the application. Any interested <br />person who disagrees with the Director's decision may request that <br />the application be considered by the Marion County Hearings officer <br />after a public hearing. The applicant may also request reconsider- <br />ation on the basis of new information subject to signing a waiver <br />of the 120 day time limit for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying <br />a $50.00 fee.
