Condition D -- Prior to plat approval provide a notarized Road Maintenance Agreement for the private <br />access easement to be recorded concurrently with the subdivision plat. <br />Condition E — Prior to plat approval, design, permit and construct a stormwater detention system to <br />attenuate runoff from the proposed paved road to not exceed pre -development conditions. <br />4 The applicant shall submit documentation satisfactory to the Marion County Surveyor to accomplish the final <br />subdivision plat. The applicant is advised that a plat service report from a title company must be submitted with <br />the final mylar. <br />5. All easements (utility, drainage, septic, etc.) required by reviewing agencies shall be shown on the final plat. <br />6. The applicant proposes a private access easement; the easement shall be named in accordance with the <br />requirements of Marion County Code Chapter 11.55. The final approved name "Donald Lane SE" shall be shown <br />on the plat and the access easement shall also provide for utilities. <br />7. Prior to recording the final plat, the applicant shall apply for, and pay, any fees associated with the street signs for <br />any proposed private roads. <br />8. A well monitoring plan meeting the requirements of MCC 17.181.120(B) shall be submitted for peer review and <br />approval. The approved plan shall be implemented prior to issuance of building permits on the resultant lots. <br />9. The applicant is advised that prior to recording the final plat, all property taxes due to Marion County must be <br />paid in full. <br />10. Prior to issuance of building permits on the resulting lot, the property owner shall sign and submit a Sensitive <br />Groundwater Overlay Zone Declaratory Statement to the Planning Division for each resulting parcel. This <br />statement shall be recorded by the applicant with the Marion County Clerk's Office after it has been reviewed and <br />signed by the Planning Director. <br />11. In accordance with Marion County Ordinances and OAR 340-21-060, during the land clearing and road <br />construction phase of this development, dust suppression measures such as water trucks shall be employed as <br />necessary to prevent off site deposition of dust generated by the construction activities or related vehicular traffic <br />on adjacent properties. <br />12. All parcels shall be a minimum of two acres in size. <br />13. If any development is proposed in the geohazard located on the northern portion of the subdivision, a geologic <br />assessment shall be required prior to approval of building permits. <br />APPEAL PROCEDURE: This decision may be appealed to the Marion County Board of Commissioners by submitting <br />a written appeal explaining wherein the Marion County Planning Commission decision is in error, along with a fee of <br />$500.00. The appeal must be received in the Marion County Clerk's Office, 555 Court St. NE, Salem, by 5:00 p.m. on <br />March 18, 2022. If an appeal is received it will be reviewed by the Board of Commissioners to determine if it <br />merits further hearing and consideration by the Board. The subject property is located outside an Urban Growth Boundary, designated Rural Residential in the Marion <br />County Comprehensive Plan, and zoned AR (Acreage Residential). <br />
