line would increase the setbacks from the EFU parcels (Tax Lots 200, 400, and 500) by <br /> 190 feet. MCC 17.36.100(B) is satisfied. <br /> MCC 17.165.080(B)(1-2) requires a 20-foot front yard setback from public rights- <br /> of-way and 10-foot side and rear yard setbacks. The new proposed property line would <br /> only encroach on one structure — the structure located on Tax Lot 800. The new property <br /> line would be over 200 feet from the structure on Tax Lot 800. MCC 17.165.080(B) is <br /> satisfied. <br /> All of the applicable approval criteria are satisfied. <br /> F. Conclusion <br /> The applicant seeks an irrevocably committed exception to Goal 3, a <br /> comprehensive plan amendment from Primary Agriculture to Industrial, a zone change <br /> from EFU to Industrial, and a property line adjustment. The staff report found that all of <br /> the applicable approval criteria are satisfied. There is no opposition to the application. I <br /> agree with the staff report that all of the approval criteria for the goal exception, <br /> comprehensive plan amendment, zone change, and property line adjustment are satisfied. <br /> VII. Recommendation <br /> It is hereby found that the applicant has met the burden of proving that the <br /> approval criteria for an irrevocably committed developed exception to Goal 3, a <br /> Comprehensive Plan designation amendment from Primary Agriculture to Industrial, a <br /> zone change from EFU to Industrial, and a property line adjustment have been met. The <br /> hearings officer recommends APPROVAL of the proposal with following conditions of <br /> approval. <br /> VIII. Conditions of Approval <br /> Planning Conditions: <br /> 1. Property line adjustment deeds shall be recorded with the county clerk meeting <br /> requirements in ORS 92.190(4). The deeds shall contain the names of the <br /> parties, the description of the adjusted lines, references to original recorded <br /> CP/ZC/PLA 21-001-RECOMMENDATION-32 <br /> WING PROPERTIES,LLC <br />
