unit of land affected by the property line adjustment is larger than the <br /> size granted by the waiver. <br /> "5. Any property line adjustment that results in an existing dwelling being <br /> located on a different parcel shall not be subject to the standards in MCC <br /> 17.136.030(A) so long as the adjustment: <br /> "a. Does not increase any adverse impacts on the continued practice of <br /> commercial agriculture on the resulting parcels; <br /> "b. Does not increase the potential number of dwellings on the resulting <br /> parcels; and <br /> , "c. Does not allow an area of land used to qualify a tract for a dwelling <br /> based on an acreage standard to be used to qualify another tract for a <br /> dwelling if the land use approval would be based on an acreage <br /> standard." <br /> MCC 17.136.090(C)(1) distinguishes between situations when one or more, all, or <br /> none of the parcels involved in the property line adjustment meet the minimum lot size. <br /> As all of the parcels involved in the property line adjustment are below the minimum lot <br /> size, the minimum parcel size does not apply to the property line adjustment. MCC <br /> 17.136.090(C)(1) is satisfied. <br /> MCC 17.136.090(C)(2) applies to situations where the minimum lot size is more <br /> than 80 acres and one of the lots involved in the property line adjustment is more than 80 <br /> acres but less than the minimum lot size. That situation is not present in this case as all of <br /> the parcels involved are below 80 acres. MCC 17.136.090(C)(2) is not applicable. <br /> MCC 17.136.090(C)(3) requires that the property line adjustment will result in a <br /> configuration that is at least as suitable for commercial agriculture as before the property <br /> line adjustment. The proposed property line adjustment will result in a configuration that <br /> is no less suitable for commercial agriculture than before the proposed property line <br /> adjustment as the parcel is not currently suitable for commercial agriculture.
