table that addresses the potential for growing all of the listed crops.3 Table C explains the <br /> difficulties of trying to produce all of the listed farm crops. The table is very persuasive <br /> and there is no contrary evidence. Rather than repeat all of the information in Table C, I <br /> adopt and incorporate Table C in this recommendation. <br /> The applicant has addressed all of the applicable factors that bear on whether an <br /> irrevocably committed exception should be granted. The crux of the issue is whether <br /> considering all of these factors farm use of the proposed exception area is impracticable. <br /> OAR 660-004-0028(4)provides: <br /> "A conclusion that an exception area is irrevocably committed shall be supported <br /> by findings of fact that address all applicable factors of section (6) of this rule and <br /> by a statement of reasons explaining why the facts support the conclusion that uses <br /> allowed by the applicable goal are impracticable in the exception area." <br /> The applicant has demonstrated that it is impracticable to grow hops, vegetables, <br /> tree fruits and nuts, berries, grass and legume seed, hay, grain, nursery stock, sugar beet <br /> and seed, or run livestock or run a dairying operation. As discussed, these are the types of <br /> farm uses that the MCCP envisions for the area. There is no evidence that any other types <br /> of farm uses are practicable on the proposed exception area. The applicant has <br /> demonstrated that farm use is impracticable on the proposed exception area due to the <br /> surrounding parcels that are not in farm use. <br /> These parcels surround the proposed exception area, with the exception of the west <br /> and east border at a width of 190 feet. The Shank Road right-of-way effectively separates <br /> the use of the proposed exception area for farming by the farm use to the west, as it <br /> would not be practicable for farm vehicles and other large equipment to cross the county <br /> road at this location in order to raise and harvest such a small crop in a confined area.
