subsection of the Oregon Transportation Planning Rule (TPR) that identifies <br /> transportation improvements that may be allow on rural lands, consistent with Goal 3. <br /> Widening of roads, including public roads and highway projects, is a permitted use in the <br /> EFU zone where the improvement is accommodated within the right-of-way, does not <br /> remove or replace buildings, and does not create a new parcel. These types of <br /> transportation improvements do not require a Goal Exception. <br /> ORS 215.283, which governs uses permitted in EFU zones, permits reconstruction or <br /> modification of public roads and highways in EFU. While ORS 215.283 does not explicitly <br /> address roadway realignments, the TPR section that governs improvements on rural lands <br /> confirms that realignment of roadways is consistent with Goal 3, Agricultural Lands (OAR <br /> 660-012-0065(3)(d)) and does not require a Goal Exception. <br /> Pursuant to ORS 215.283(2)(q), construction of additional passing and travel lanes is also <br /> allowed subject to County approval. Construction of additional travel lanes is listed as a <br /> conditional use in MCC 17.136.050. Realignment and widening of Ehlen Road, Bents Road, <br /> or Dolores Way on EFU land in the vicinity of the interchange does not require a <br /> Statewide Goal Exception, but County conditional use approval will be needed before <br /> additional lanes on Ehlen Road can be constructed as part of Phase 2 improvements. <br /> Widening of Ehlen Road will be subject of a future conditional use approval request and <br /> will be reviewed by the County pursuant to MCC Chapter 17.119 Conditional Uses. <br /> Goal 2 and related Oregon Administrative Rules (OAR 660-033) and Statutes (ORS 215), <br /> have been met. <br /> STATEWIDE PLANNING GOAL 4: To conserve forest lands. <br /> This Goal is not applicable to the requested action. There is no land designated for forest <br /> use in the vicinity of the interchange. <br /> STATEWIDE PLANNING GOAL 5: To protect natural resources and conserve scenic and <br /> historic areas and open spaces. <br /> The existing conditions in the TAMP study area with respect to natural and cultural <br /> resources are described in TAMP Chapter 2, Existing Conditions and Inventory Analysis, <br /> and Appendix E (Natural Resources Memorandum), Appendix F (Wetland and Waters <br /> Determination Memorandum), and Appendix J (Archaeologic Resources Memorandum). <br /> The Preferred Alternative would have impacts to the built and natural environments, but <br /> for a project of its size and scale, the impacts are relatively minor (see TAMP Section 5.3.3 <br /> Environmental Impacts). ODOT and the Federal Highway Administration completed <br /> federal environmental documentation to support a National Environmental Policy Act <br /> categorical exclusion in terms of environmental permitting because the project's <br /> individual and cumulative impacts are not significant on the natural and built <br /> environments. <br /> As documented in the TAMP, Section 4(f) of the U.S. Department of Transportation <br /> (USDOT) Act of 1966 prohibits the Federal Highway Administration and other USDOT <br /> I-5:Aurora Donald Interchange(Exit 278)TAMP:Supporting Findings for Marion County Adoption 7 <br />
