BEFORE THE BOARD OF COMMISSIONERS <br />FOR MARION COUNTY, OREGON <br />In the Matter of the <br />Application of: <br />Mark Montecalvo and Scott Martin <br />Case No. 'ZC/ADJ 11-001 <br />Clerk's File No. 5662 <br />AN ADMINISTRATIVE ORDINANCE <br />ORDER/ORDINANCE NO. It/ <br />THE MARION COUNTY BOARD OF COMMISSIONERS HEREBY ORDAINS AS <br />FOLLOWS: <br />SECTION I. PuMose <br />This matter comes before the Marion County Board of Commissioners ("Board") on the <br />application of Mark Montecalvo and Scott Martin to change the zone on a 0.15 acre parcel from <br />UD (Urban Development) to RM (Multiple -family Residential), obtain adjustments to allow <br />more than four dwellings to be served by a private roadway and to reduce the number of required <br />parking spaces from eight to six on property located at 4465 Blueberry Lane NE, Salem (T7S; <br />R2W; Section 7DC; tax lot 401). <br />SECTION Il. Procedural HistoKy <br />The Hearings Officer held a public hearing on this application on April 27, 2011. On July 15, <br />2011 the Hearings Officer issued a recommendation to grant the zone change and deny the , <br />adjustments to allow more than four dwellings to be served by a private roadway and to reduce <br />the number of required parking spaces from eight to six. Official notice was taken of the <br />Planning Division file and the Hearings Officer's recommendation. The Board considered <br />evidence in the record, all -arguments of the parties and is otherwise fully advised in the premises. <br />SECTION III. Adoption of Findings and Conclusion <br />After careful consideration of all facts and evidence in the record, the Board adopts as its own <br />the Findings of Facts and Additional Findings of Fact and Conclusions of Law contained in <br />Section IV and V of the Hearings Officer's recommendation dated July 15, 2011, contained in <br />Exhibit A, attached hereto, and by this reference incorporated herein. . <br />
