BEFORE THE BOARD OF COMMISSIONERS FOR MARION COUNTY, OREGON In the Matter of the Application of: Mark Montecalvo and Scott Martin Case No. 'ZC/ADJ 11-001 Clerk's File No. 5662 AN ADMINISTRATIVE ORDINANCE ORDER/ORDINANCE NO. It/ THE MARION COUNTY BOARD OF COMMISSIONERS HEREBY ORDAINS AS FOLLOWS: SECTION I. PuMose This matter comes before the Marion County Board of Commissioners ("Board") on the application of Mark Montecalvo and Scott Martin to change the zone on a 0.15 acre parcel from UD (Urban Development) to RM (Multiple -family Residential), obtain adjustments to allow more than four dwellings to be served by a private roadway and to reduce the number of required parking spaces from eight to six on property located at 4465 Blueberry Lane NE, Salem (T7S; R2W; Section 7DC; tax lot 401). SECTION Il. Procedural HistoKy The Hearings Officer held a public hearing on this application on April 27, 2011. On July 15, 2011 the Hearings Officer issued a recommendation to grant the zone change and deny the , adjustments to allow more than four dwellings to be served by a private roadway and to reduce the number of required parking spaces from eight to six. Official notice was taken of the Planning Division file and the Hearings Officer's recommendation. The Board considered evidence in the record, all -arguments of the parties and is otherwise fully advised in the premises. SECTION III. Adoption of Findings and Conclusion After careful consideration of all facts and evidence in the record, the Board adopts as its own the Findings of Facts and Additional Findings of Fact and Conclusions of Law contained in Section IV and V of the Hearings Officer's recommendation dated July 15, 2011, contained in Exhibit A, attached hereto, and by this reference incorporated herein. .
