FINDINGS AND CONCLUSIONS: The findings and conclusions on which the Planning Director <br />based the decision are noted below. <br />The subject parcel is located within the Salem Urban Growth Boundary (UGB), designated <br />Single Family Residential in the Salem Area Comprehensive Plan, and zoned UD (Urban <br />Development). The UD (URBAN DEVELOPMENT) zone is under the jurisdiction of <br />Marion County. <br />2. The subject parcel is located at the southwest corner of Hayesville Drive and Reimann Street <br />NE. The property contains three single-family dwellings and accessory structures. <br />3. Properties to the east are zoned UD and consist of various sized lots containing single-family <br />dwellings. Properties to the north, south, and west are zoned RS and developed as single- <br />family subdivisions. <br />4. The applicants propose to divide a 24,393 square foot parcels into 3 lots containing 6,000 <br />square feet, 6,000 square feet, and 12,393 square feet each. An existing dwelling will remain <br />on each of the proposed lots all of which will front on Hayesville Drive. The subject <br />property is described by deed recorded on May 17, 1973 prior to adoption of County <br />ordinances requiring a review of land divisions of this type. The property is considered a <br />legal parcel for land use purposes. <br />5. Marion County Public Works issued comments as follows: <br />STREETS <br />In accordance with Marion County Driveway Ordinance #651, if this partition is approved, <br />the applicant will be required to apply for driveway "Access Permits" for any future <br />revision(s) to existing accesses to proposed parcels #1, #2 & #3. Driveways must meet sight <br />distance, design, spacing, and safety standards. <br />The existing gravel driveway on Hayesville Drive NE serving the parent parcel (proposed <br />parcel #3) shall be closed. Access to parcel 43 shall continue to be from the existing access <br />to Reimann Avenue NE, as depicted on the application tentative site plan. If and when <br />access to Reimann Street NE is redone as part of redevelopment, one and only one access <br />would be approved. <br />Frontage improvements are not required at this time. However, if and when redevelopment <br />on the subject property were to occur, the applicant will be required to improve Hayesville <br />Drive NE and Reimann Street NE along their property frontage to City of Salem standards as <br />directed by the Marion County Public Works Department. This will include such elements <br />as providing a 17 -foot paved half -width (Hayesville Drive NE only) and transition taper, curb <br />and gutter, property line sidewalk, ADA sidewalk ramp at the corner of Hayesville Drive NE <br />and Reimann Street NE., through -curb drains and landscaping. Engineered plans must be <br />submitted and approved by the Marion County Public Works Department prior to <br />construction permit issuance. <br />
