FINDINGS AND CONCLUSIONS: The findings and conclusions on which the Planning <br />Director based the decision are noted below. <br />1. The property is in the Salem/Keizer Urban Growth Boundary (UGB) and designated <br />Single Family Residential in the Salem Area Comprehensive Plan (SACP). The parcel is <br />zoned RS (SINGLE FAMILY RESIDENTIAL) under the jurisdiction of Marion County. <br />2. The property is located on the north side of Haysville Drive NE, 105 feet west of its <br />intersection with Homer Road NE. The parcel has a dwelling and an accessory structure. <br />The property is described as Lot 6 of Reimann Gardens subdivision and is a legally <br />created parcel. <br />All surrounding properties are zoned RS and are developed with single-family dwellings. <br />4. The applicants proposes to divide a 33,541 square foot parcel into three parcels of 7,352, <br />6,832 square feet, and 20,496 square feet. <br />Comments on the subject application received from various governmental agencies are <br />summarized below. The full comments can be reviewed in the planning file. <br />Marion County Land Development Engineering & Permits: <br />Chapter 172 of the Rural Zoning Ordinance of Marion County, Oregon, requires the <br />applicant to dedicate sufficient right-of-way on the plat to provide the public <br />dedicated right-of-way half -width of thirty feet along Hayesville Road NE. This is <br />the standard right-of-way half width for a collector street in the Salem Transportation <br />System Plan (TSP). It appears that no additional width is required. Any dedications <br />should be to the public, not Marion County. <br />• Earlier partitions of the properties to the east and west of the subject property required <br />a 34 -foot right-of-way half width dedication. Four additional feet of right-of-way <br />was required. In order to accommodate utilities that may utilize this area, the <br />applicant shall show a four -foot utility easement on the plat. <br />Prior to plat approval, the applicant will be required to improve Hayesville Road <br />along their property frontage to City of Salem standards as directed by the Public <br />Works Department. This will include such elements as a 17 -foot paved half -width, <br />curb, gutter, property line sidewalk, transition tapers at both ends, drainage work, and <br />landscaping. Engineered plans must be submitted and approved by the Public Works <br />Department prior to plat approval. <br />• In order to minimize the number of access points, the driveway serving the existing <br />dwelling on Parcel 1 shall be closed and access provided by a shared easement along <br />the west property line. <br />According to City of Salem Development Bulletin #34, March 1, 2000, the minimum <br />access spacing standard for a collector street 200 feet between the centerline of a <br />driveway to the centerline of an adjacent intersecting street. The driveway along the <br />west property line, as proposed by the applicant, does meet the access spacing <br />
