NOTICE TO MORTGAGEE, LIENHOLDER, VENDOR, OR SELLER: ORS CHAPTER 215 <br />REQUIRES THAT IF YOU RECEIVE THIS NOTICE, IT MUST PROMPTLY BE FORWARDED TO <br />THE PURCHASER. <br />NOTICE OF DECISION <br />PARTITION/ADMINISTRATIVE REVIEW CASE NO. 07-47 <br />APPLICATION: Application of Robert Eberle, Jr. and Troy Eberle for approval, under waivers granted by <br />ORS 197.352 (Measure 37) to divide a 3.57 acre parcel into 2 parcels containing 1.84 acres and 1.73 acres each <br />and an administrative review to reduce the special 200 foot dwelling setback in a FT (Farm Timber) zone <br />located in the 3,000 block of Seminole Road NE, Silverton (T7S; R1E; Section 7D; tax lots 1100 and 1200). <br />Review is subject to the criteria contained in State final order # M129825 and Marion County Order #07-6. <br />DECISION: Notice is hereby given that the Planning Director for Marion County has APPROVED the above - <br />described Partition application subject to certain conditions. <br />EXPIRATION DATE: This approval is valid only when the final partitioning plat is recorded by JULY 12, <br />2009. After recording the final partitioning plat, the applicant shall provide proof of the recording to the <br />Planning Division. This can be either a copy of the recording fee receipt or a copy of the plat showing the <br />County Clerk's stamp. The effective period of an approved application may be extended for an additional year <br />subject to approval of an extension (Extension form available from the Planning Division). Additional <br />extensions may not be granted if the regulations under which this decision was granted have changed <br />since the original approval. <br />WARNING: A decision approving the proposed division or use is for land use purposes only. Due to septic, <br />well, and drain field replacement areas, these parcels may not be able to support a dwelling. To be sure the <br />subject property can accommodate the proposed use the applicant needs to check with the Building Inspection <br />Division, (503) 588-5147. <br />This decision does not include approval of a building permit. <br />CONDITIONS: The following conditions must be met before a building permit can be obtained or the <br />approved use established: <br />1. Prior to issuance of any building permit(s) the applicant shall submit a final partitioning plat to the <br />County Surveyor's Office (5155 Silverton Road NE; (503) 588-5036). Following plat approval, the plat <br />shall be recorded with the Marion County Clerk (final plat instructions and example enclosed). <br />2. Transferring ownership of the subject property from the ownership of Robert Eberle, Jr. prior to <br />the plat being recorded could void this approval. <br />3. The applicant is advised that a current title report, from a title company, will be required upon <br />submission of the final Mylar to the County Surveyor. <br />4. For a Partition Plat resulting from a Measure 37 case, the following statement must be shown below the <br />Marion County Planning Director signature blank: "MEASURE 37 WAIVER NOTICE: The Parcels <br />shown on this Plat were authorized by waivers of land use regulations by Marion County and the State <br />of Oregon pursuant to ORS 197.352 and Marion County Ordinance #1209 as amended and filed in the <br />Marion County Clerk's Office. Marion County makes no warranties as to the transferability of the <br />Parcels or any development rights related to the Parcels." <br />
