EXHIBIT B <br /> Conditions of Approval <br /> 1. If developed in phases, the order of each phase shall remain flexible, but the development must <br /> be consistent with the plan submitted with this request. <br /> 2. Prior to approval and recording the final plat for any phase , the applicants shall obtain <br /> approval from Marion County and DEQ for sewage disposal. This includes any individual <br /> septic systems and community wastewater collection system. <br /> 3. Prior to approval and recording the final plat applicant shall obtain a 1200 C permit from <br /> Oregon Department of Environmental Quality. <br /> 4. Prior to approval and recording the final plat for any phase, the applicant shall submit evidence <br /> of compliance with the development and access standards of the Stayton Fire District. <br /> 5. Prior to approval and recording of the final plat for any phase, the applicant shall submit <br /> evidence of compliance with the requirements recommended by Marion County Department of <br /> Public Works specifically as follows: <br /> (a) In accordance with Chapter 172 of the Rural Zoning Ordinance of Marion County, the <br /> applicant shall show sufficient dedicated right-of-way on the plat to provide the public <br /> dedicated right-of-way half-width of 30 feet along North Fork Road and Gates Hill <br /> Road standard radius at curves and corners as well as provide for any cut or fill slopes, <br /> or roadside ditches,to be within the public right-of-way. Any dedications should be to <br /> the public, not Marion County. <br /> (b) The developer shall improve North Fork Road along its frontage to applicable Public <br /> Works' standards including,but not limited to,pavement overlay, gravel shoulders, <br /> drainage work, slope work, and vegetation clearing. Any additional landscaping within <br /> the right-of-way of North Fork Road would need to be approved by the County and <br /> provisions would need to be made to ensure its active maintenance by a private entity <br /> associated with the proposed development. <br /> (c) The developer is encouraged to provide grade-separation (bridges) for any trails <br /> crossing North Fork Road, and trails shall be designed to discourage random crossings <br /> of County roads. All proposed pedestrian/trail crossing improvements on or near <br /> County roads, including grade separated crossings, shall be located and designed in <br /> accordance with Public Works' standards. <br /> (d) Roads serving the subdivision should be constructed in compliance with the County <br /> design standards for public roads. Easements should match standard right-of-way <br /> widths. Part of this planned unit development must include a homeowners' association <br /> or other entity that will take full responsibility for maintaining these roads. This will <br /> need to be officially created and documented to the satisfaction of the Public Works <br /> Department before final plat approval for the residential phase of the development. <br /> 1 <br />
