<br />MARION COUNTY PLANNING DIRECTOR’S MEASURE 37 REPORT <br /> <br /> <br />Measure 37 Application of Marcus Berlin ) Case No. M06-289 <br /> <br /> <br />APPLICATION <br /> <br />The applicant, Marcus Berlin, requests compensation under ORS 197.352 (Measure 37) for being denied a <br />request to place a dwelling on a 1.35 acre parcel in an EFU (EXCLUSIVE FARM USE) zone located in the <br />9900 block of Sydney Road S, Salem (T9S; R3W; Sec.8; tax lot 600). <br /> <br /> <br />BACKGROUND <br /> <br />The Marion County Planning Division has reviewed the above-referenced application and offers the <br />following comments: <br /> <br />1. The subject property is designated Primary Agriculture in the Marion County Comprehensive Plan <br />and correspondingly zoned EFU in the Marion County Rural Zoning Ordinance (MCRZO). <br /> <br />2. The vacant property is located approximately 400 feet west of Sydney Road and approximately ¾ of <br />a mile west of Buena Vista Road and within the 100-year floodplain of the Willamette River. <br /> <br />3. Surrounding properties in every direction are zoned EFU and primarily in agriculture production. <br /> <br />4. Soil # % of Parcel SCS Soil Class High Value? <br /> Concord 90.4 III Yes <br /> Amity 9.6 II Yes <br /> <br />5. The property was not subject to any previous land use cases. <br /> <br />6. The applicant requests compensation under Measure 37 for being denied in a land use verification <br />letter dated November 27, 2006 a request to place a dwelling on the subject property. <br /> <br />7. The applicant acquired an ownership interest in the property by court order on April 4, 1983, and <br />claims prior family ownership back to July 20, 1966, when his grandfather, Porter Wyatt Magness, <br />acquired the property. <br /> <br />AGENCY/OTHERS COMMENTS: <br /> <br />8. Comments below are from interested agencies and individuals. Those from individuals may be only <br />narrative. The full comments can be reviewed in the planning file. <br /> <br />Marion County Department of Public Works reviewed the proposal and provided the following <br />comments. “Approval of the proposed development would allow a dwelling on the subject property, <br />resulting in approximately 10 additional daily trips on Sidney Road and other roads in the area. <br />Comments are based on this development level; changes in development level may result in changes <br /> <br />
