<br />MARION COUNTY PLANNING DIRECTOR’S MEASURE 37 REPORT <br /> <br /> <br />Measure 37 Application of Gerald Marschat ) Case No. M06-250 <br /> ) <br /> <br /> <br />APPLICATION <br /> <br />The applicant, Gerald Marschat, requests compensation under ORS 197.352 (Measure 37) for being denied <br />a request to subdivide a 21 acre parcel into 4 lots with dwellings in an EFU (Exclusive Farm Use) zone <br />located at 5588 Waconda Road NE, Salem. [T6S; R2W; Sec.4C; tax lot 700 and Sec.9; tax lot 1200]. <br /> <br />BACKGROUND <br /> <br />The Marion County Planning Division has reviewed the above-referenced application and offers the <br />following comments: <br /> <br />1. The subject property is designated Primary Agriculture in the Marion County Comprehensive Plan <br />and correspondingly zoned EFU in the Marion County Rural Zoning Ordinance (MCRZO). <br /> <br />th <br />2. The property is located 2700 feet east of the intersection with 50 Avenue NE and contains a <br />dwelling, placed without permits, and accessory structures. <br /> <br />3. Adjacent properties are zoned EFU and consist primarily of properties being farmed to the south <br />and north, rural residential homesites to the east, and naturally wooded lots to the west. <br /> <br />4. Soil # % of Parcel SCS Soil Class High Value? <br /> Concord (Co) 87% III Yes <br /> Amity (Am) 13% II Yes <br /> <br />5. The property has not been the subject of any previous land use cases. <br /> <br />6. The applicant requests compensation under Measure 37 for being denied in a land use verification <br />letter dated November 21, 2006, a request to subdivide the subject property. <br /> <br />7. The applicant acquired an ownership interest in the subject property on March 1, 1968, and does not <br />claim prior family ownership. <br /> <br />AGENCY COMMENTS <br /> <br /> <br />Comments on the subject application received from various governmental agencies are summarized <br />below. Marion County Department of Public Works Land Development and Engineering reviewed the <br />proposal and provided the following comments: “Approval of the proposed development would <br />allow subdivision of the subject property into four lots and allow construction of single-family <br /> <br />
