<br />MARION COUNTY PLANNING DIRECTOR’S MEASURE 37 REPORT <br /> <br /> <br />Measure 37 Application of Florence, Terri, and ) Case No. M06-159 <br />Monty Zwicker, as the Zwicker Family Partnership ) <br /> <br /> <br />APPLICATION <br /> <br />The applicants, Florence, Terri, and Monty Zwicker as the Zwicker Family Partnership, request <br />compensation under ORS 197.352 (Measure 37) for being denied a request to subdivide a 105.64 acre <br />parcel into 5 acre lots and place a dwelling on the resulting vacant lots in an EFU (EXCLUSIVE FARM <br />USE) zone located at 21021 Boones Ferry Road N, Aurora (T4S; R1W; Sec.15; tax lot 600). <br /> <br /> <br />BACKGROUND <br /> <br />The Marion County Planning Division has reviewed the above-referenced application and offers the <br />following comments: <br /> <br />1. The subject property is designated Primary Agriculture in the Marion County Comprehensive Plan <br />and correspondingly zoned EFU in the Marion County Rural Zoning Ordinance (MCRZO). <br />A portion of the property is also located within the identified 100 year floodplain of Senecal Creek. <br />2. The property is located on the west side of Boones Ferry Road at the intersection with Donald <br />Road. The property contains a dwelling, accessory structures, mobile home, well and septic system. <br /> <br />3. Adjacent properties are zoned EFU and consist primarily of land in farm use. <br /> <br />4. Soil # % of Parcel SCS Soil Class High Value? <br /> Woodburn 59.8 II/III Y <br /> Wapato 38.5 III Y <br /> Amity 1.6 II Y <br /> <br />5. The property was the subject of the following previous land use cases: <br /> <br /> <br />Major Partition Case MP78-37. Request to partition 169.47 acres into two parcels. Approved <br />o <br /> <br />Variance Case V04-2. Request to place off premise signs. Denied. <br />o <br /> <br />6. The applicants request compensation under Measure 37 for being denied in a land use verification <br />letter dated October 3, 2006 a request to subdivide the subject property. <br /> <br />7. Florence Zwicker first acquired an ownership interest in the subject property on September 28, <br />1959, but transferred interest to the Zwicker Family Partnership on November 19, 1980.
