<br />MARION COUNTY PLANNING DIRECTOR’S MEASURE 37 REPORT <br /> <br /> <br />Measure 37 Application of James and ) Case No. M06-126 <br />Sandra Reed ) <br /> <br /> <br />APPLICATION <br /> <br />The applicants, James and Sandra Reed, request compensation under ORS 197.352 (Measure 37) for <br />being denied a request to place a dwelling on a 5.84-acre parcel in an EFU (Exclusive Farm Use) zone <br />located in the 10,900 block of Mill Creek Road SE, Aumsville (T8S; R1W; Section 32C; Tax lot 100). <br /> <br />BACKGROUND <br /> <br />The Marion County Planning Division has reviewed the above-referenced application and offers the <br />following comments: <br /> <br />1. The subject property is designated Primary Agriculture in the Marion County Comprehensive Plan <br />and correspondingly zoned EFU in the Marion County Rural Zoning Ordinance (MCRZO). <br /> <br />2. The vacant property is located a half-mile east from the intersection with State Highway 22. <br /> <br />3. Adjacent properties are zoned EFU and consist primarily of a mixture of rural homesites and farm <br />uses. <br /> <br />4. The property has not been the subject of any previous land use cases. <br /> <br />6. Marion County Ordinance No. 1209, Section 4 outlines the application requirements for filing a <br />Measure 37 claim. The applicant failed to provide a statement and evidence of reduction in market <br />value. A letter was sent to the applicant on November 13 and December 7, 2006, requesting <br />submittal of this information. As of this date, the applicants had not responded. <br /> <br />7. The applicants request compensation under Measure 37 for being denied in a land use verification <br />letter dated September 26, 2006, a request to place a dwelling on the subject property. <br /> <br />8.
