This <br />decision is effective SEPTEMBER 6, 2006 unless further consideration is requested. <br />FINDINGS AND CONCLUSIONS: The findings and conclusions on which the Planning <br />Director based the decision are noted below. <br />The property is designated Single Family Residential in the Salem Area Comprehensive <br />Plan. The major purpose of this designation and the corresponding UD (Urban <br />Development) zone is to provide areas for Residential development. <br />2. The property is located at the southeast corner of the intersection of Milky Way and 45th <br />Avenue NE. The property contains a single family dwelling was lawfully created by <br />Major Partition Case No 79-117. <br />3. Surrounding uses on all sides are other single family dwellings. <br />4. The applicant proposes divide a 15,682 square foot parcel into two lots of 9682 square <br />feet ad 6,000 square feet. The existing dwelling will remain on the proposed 9,682 <br />square foot lot. <br />5. The Marion County Department of Public Works commented: "Approval of the proposal <br />will create one additional home site on the subject property resulting in approximately 10 <br />additional trips daily on 45th Avenue and other roads in the area. The Public Works <br />Department has the following comments, requirements, and recommendations for the <br />proposed partition: <br />STREETS <br />Chapter 33 of the Urban Zoning Ordinance of Marion County, Oregon, requires the <br />applicant to dedicate sufficient right-of-way on the plat to provide the public dedicated <br />right-of-way of thirty feet along 45th Avenue. This is the standard right-of-way width for <br />a Collector Street. However, it appears that no additional width is required. Any <br />dedications would be to the public, not Marion County. <br />If this partitioning case goes forward, the developer would be required to improve 45th <br />Avenue along their frontage in accordance with appropriate standards as directed by <br />Public Works. This will include such elements as pavement widening, curb, gutter, <br />property line sidewalk, and landscaping. <br />In accordance with Chapter 33 of the Urban Zoning Ordinance, improvements shall be <br />made along Milky Way as necessary to provide a 20 -foot paved access way within a 25 - <br />foot easement. <br />In accordance with Marion County Driveway Ordinance #651, driveway permits will be <br />required for any new access, change in existing access to the public right-of-way, or <br />access for any new residence. <br />
