5. The East Salem Sewer and Water Districts, and the Salem Transit <br />District serve the subject property. Electrical, telephone and <br />other services are available to the property. A driveway permit <br />will ensure adequate access to the public right of way. Drainage <br />plans approved by DPW will ensure stormwater runoff is adequately <br />managed. Adequate public facilities and transportation networks <br />are available or will be provided concurrent with development. <br />MCUZO 30.05(b) is satisfied. <br />6. The SACP contains no zone change review criteria. MCUZO 39.05(c) <br />is not applicable. <br />7. According to MCUZO 3.00, the purpose of the RL zone is to provide <br />for detached or attached dwellings on a lot or multiple dwellings <br />on a lot at an intermediate density. Other uses compatible with <br />residential development are also appropriate. RL zones are located <br />in areas designated Multiple Family Residential or an equivalent <br />designation in the applicable urban area comprehensive plan and <br />are provided with urban services. They should be located near the <br />perimeter of lower density residential areas. <br />The subject property is designated Multi -Family Residential in the <br />SACP, and adequate public services are available to serve the <br />subject property. The subject property is in an area that includes <br />single family residential development. The proposed development is <br />consistent with the intent and purpose -of the RL zone. MCUZO <br />30.05(d) is satisfied. <br />13. The proposed RL zone is the most restrictive residential zone <br />allowed under the Multiple Family Residential designation. MCUZO <br />39.05(e) is not applicable. <br />VI. Recommendation <br />It is hereby found that applicants have met the burden of proving the <br />applicable standards and criteria for approval of a zone change from UD <br />to RL on a 0.57 -acre parcel have been met. Therefore, approval of the <br />zone change application is RECOMNENDED, subject to the conditions set <br />forth below. The conditions are necessary for the public health, safety <br />and welfare. <br />1. Applicants shall obtain all permits required by the Marion County <br />Building Inspection Division. <br />2. Applicants shall obtain a driveway permit for access to the public <br />right-of-way through the building permit process. <br />ZC03-9 - ORDER 7 <br />
