9. All utilities shall be placed underground. <br />10. The private easement shall be extended through parcel 5 and shall be a minimum 25 feet <br />in width with 20 feet of paved surface. <br />APPEAL PROCEDURE: this decision may be appealed to the Marion County Board of <br />Commissioners by submitting a written appeal explaining wherein the Marion County Planning <br />Commission's decision is in error along with a fee of $500.00. The appeal must be received in <br />the Marion County Clerk's Office, 110 High Street NE, Salem by 5:00 p.m. SEPTEMBER <br />30, 2003. If an appeal is received it will be reviewed by the Board of Commissioners to <br />determine if it merits further hearing and consideration by the Board. Questions regarding this <br />action or the appeal procedure may be directed to the Marion County Planning Division, 555 <br />Court Street NE, Salem, phone (503) 588-5038. <br />FINDINGS AND CONCLUSIONS: The Planning Commission's decision is based on the <br />findings and conclusions below. <br />1. The subject parcel is located within the Salem/Keizer Urban Growth Boundary (UGB), <br />designated Single Family Residential in the Salem Area Comprehensive Plan, and zoned <br />both RS and UD. The UD Zone permits subdivisions under the provisions of the RS <br />Zone where public sewer and water are available and the development complies with the <br />provisions of Chapter 33 of the Urban Zoning Ordinance. <br />2. The subject parcel is undeveloped and is bisected north to south by a drainage ditch. The <br />property has frontage on both Hollywood and Tierra Drives. <br />3. Properties surrounding the subject parcel are designated as residential and are primarily <br />developed with single family dwellings. To the south of Tierra Drive is a large <br />undeveloped parcel. <br />AGENCY COMMENTS: <br />4. The Marion County Surveyor commented that the subdivision name must be approved <br />per ORS 92.090. In addition, the subdivision must be surveyed and platted per ORS <br />92.050 and the final plat (along with appropriate fees and additional mylar fee) submitted <br />to their office for their review and approval. The final plat must be submitted with a <br />plant service report and/or title report to their office. <br />The Marion County Tax Department noted that all current taxes are paid in full. A <br />potential additional tax liability may exist which may need to be paid before a <br />subdivision would be approved. According to ORS 92.095, all delinquent taxes and <br />interest as well as taxes which have become a lien during the tax year must be paid before <br />the plat shall be recorded. <br />6. School District 24J noted that the proposed development is projected to add 2 students to <br />the Scott Elementary School, 1 student to the Waldo Middle School and 2 students to <br />
