10. <br /> <br />All other contacted agencies either failed to respond, or stated no objection to the proposal, at <br />the time this report was written. <br /> <br />Section 136.090 (a)(1) of the Marion County Rural Zoning Ordinance allows for the creation <br />of new parcels of farm land subject to the following standards: <br /> <br />(a) All parcels wholly or in part within 500 feet of the subject parcel shall be identified. <br /> <br />The average (mean) size of all parcels larger than 40 acres identified in paragraph (a) <br />of this subsection shall be determined. <br /> <br />(c) <br /> <br />The acreage size calculated in paragraph (b) of this subjection, rounded to the nearest <br />10 acres, is the minimum parcel size, unless such parcel is less than 80 acres, in <br />which case the minimum parcel size is 80 acres. <br /> <br />The applicant provided the parcels' sizes concurrent with the requirements of 136.090(a)(1) <br />for seven parcels within 500 feet of the subject parcel, which are over 40 acres in size: <br /> <br />Map & Tax Lot Acres <br /> <br />8S 2W 12 500 86 <br />8S 1W 07 900 124 <br />6S2W 13 100 198.1 <br />8S 1W 18 800 44.8 <br />8S 1W 08 800 '5533 <br />8S 1W 08 1400 76.4 <br />8S lW 08 1200 96.96 <br />8S lW 17 600 94.9 <br />8S 1W 17 900 72.91 <br /> <br />The average parcel size was determined to be 94.38 acres, which, when rounded to the <br />nearest 10 acres, gives a minimum parcel size of 90 acres for any new farm parcel created as <br />a result of this application. Staff confirmed the applicant's analysis and conclusion. Parcels <br />proposed for creation are at least 90 acres in size, therefore, the applicant meets the criteria <br />for dividing the property and the partitioning portion of this application is APPROVED, <br />subject to meeting certain conditions. <br /> <br />Craig O.
