A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Please note an appeal directly to <br />the Land Use Board of Appeals is not allowed under ORS 197.830. This decision is effective DECEMBER 03, 2002 unless further consideration is requested. <br /> <br />FINDINGS AND CONCLUSIONS: The findings and conclusions on which the Director based his <br />decision are noted below. <br /> <br />The property is designated Rural Residential in the Marion County Comprehensive Plan. The <br />purpose of this designation and the corresponding AR (Acreage Residential) zone is to allow <br />for the creation of acreage homesites at a density that maintains the character and <br />environmental quality of the County's rural residential areas. The property is also located in a <br />Significant Groundwater Overlay (SGO-5) zone. <br /> <br />The property is located in Spring Lake Estates Subdivision on the west side of Oak Drive SE, <br />approximately 600 feet north of its intersection with Valley Drive SE. The property is <br />currently undeveloped and was lawfully created when the plat for this portion of the <br />subdivision was recorded in April, 1971. <br /> <br />3. The surrounding properties consist of a rural residential subdivision that is zoned AR. <br /> <br />The applicant proposes to divide a 7.6 acre parcel into two parcels containing 4.6 acres and 3 <br />acres each. Each of the resulting parcels will maintain frontage on Oak Drive, however, the <br />submitted site plan indicates they may share a driveway. <br /> <br />Marion County Surveyor's Office indicates that parcels 10 acres and less must be surveyed. <br />Per ORS 92.050, a Plat must be submitted for review along with required fees and a Plant <br />service report and/or title report. <br /> <br />Marion County Department of Public Works reviewed the proposal and provided the following <br />comments: <br /> <br />"Approval of the proposed partition will create two an additional home site on the <br />subject property resulting in additional traffic on Oak Drive SE. The following <br />requirements address impacts created by approval of the proposed partition: <br /> <br />The subject property is within the unincorporated area of Marion County. <br />Transportation and Parks Systems Development Charges shall be assessed upon <br />development of the home on the newly created parcel, at the time of application <br />for building permits. <br /> <br />In accordance with Marion County Driveway Ordinance #651,driveway permits <br />will be required for any new access or change in existing access to the public <br />right-of-way. Through the building permit process, the applicant shall be <br />required to apply for a driveway permit or an exemption from the permit <br />process. Public Works' staff will review the driveway at that time and <br /> <br /> <br />
