555 Court St. NE, 2nd Floor, Salem, by 4:30 p.m. on NOVEMBER 5~ 2002. If you have
any question about this application or the decision please call 588-5038 or visit the County
Planning Office at the above address. This decision is effective NOVEMBER 6~ 2002
unless further consideration is requested.

FINDINGS AND CONCLUSIONS: The findings and conclusions on which the Director based
his decision are noted below.

The property is designated Rural Residential in the Marion County Comprehensive Plan.
The purpose of this designation and the corresponding AR (Acreage Residential) zone is
to allow for the creation of acreage homesites at a density that maintains the character
and environmental quality of the County's rural residential areas. The property is also
located in a Sensitive Groundwater Overlay Zone (SGO-5) as well as a Geologically
Hazardous Areas Overlay Zone.

The subject parcel is located on the west side of River Springs Drive S, approximately ½
mile south of its intersection with Vitae Springs Road S. It is currently vacant land. The
parcel was lawfully created with Marion County approval of Partitioning Case #99-1 and
is recorded as Parcel 3 of Partitioning Plat No. 2001-65.

Surrounding properties to the north and east are zoned AR and consist of rural residential
lots. Property to the west and south is zoned SA (SPECIAL AGRICULTURE) and is
devoted to forest use.

The applicant proposes to divide an 8.659 acre parcel into three parcels containing 2.0
acres, 2.0 acres, and 4.659 acres each. The property is undeveloped. Access to the
proposed parcels will be via a newly created easement across an existing parcel to the
east. The new easement will also serve the easterly parcel of a partitioning filed by the
applicant for the adjacent parcel (tax lot 902) that is currently under review (P02-21).
The new easement will serve a total of 4 residential parcels and constitute a realignment
and renaming of Fern Forest Lane S that was created by P99-1. Fern Forest Lane S will
continue to serve one of the parcels created by P02-21. It should be noted that the
property is heavily wooded, and excessive topographic limitations exist at the site.

Marion County Department of Public Works reviewed the proposal and provided the
following comments:

"Approval of the proposed partition will create an additional home site on the
subject property resulting in additional traffic on River Springs Rd. The
following requirements address impacts created by approval of the proposed
partition:

The partition will create two new lots and the original house that will be severed
off a public easement to River Springs Road. This easement will also serve one
lot created by Partition P 02-21. All the lots shall enter into a road maintenance
agreement to maintain the road.
