process, the applicant shall be required to apply for a driveway permit or an exemption <br />from the permit process. Public Works' staff will review the driveway at that time and <br />determine if it is in compliance with current County standards. <br /> <br />13. <br /> <br />The partitioning plat shall substantially conform to the submitted site plan. Minor <br />variations may be allowed upon review and approval of the Principal Planner. All <br />resulting parcels must be a minimum 2.0 acres each. <br /> <br />14. <br /> <br />Prior to building permits, the owners of each of the three lots shall enter into a road <br />maintenance agreement to maintain the road as required by Marion County Public <br />Works. (contact Byron Meadows at 503-588-5036) <br /> <br />ADDITIONAL CONDITIONS: Once the approved use is established the following conditions <br />must be continually satisfied: <br /> <br />15. <br /> <br />After the final Partitioning plat has been recorded no alteration of property lines shall be <br />permitted without first obtaining approval from the Planning Director. <br /> <br />OTHER PERMITS, FEES~ AND RESTRICTIONS: This approval does not remove or affect <br />any covenants or restrictions imposed on the subject property by deed or other instrument. The <br />proposed use may require permits and/or fees from other local, State or Federal agencies. This <br />decision does not take the place of, or relieve the responsibility for obtaining other permits or <br />satisfying any restrictions or conditions thereon. It is recommended that the agencies mentioned <br />in Finding # 5 below be contacted to identify restrictions or necessary permits. The applicant is <br />advised of the following: <br /> <br />16. <br /> <br />The subject property is within the unincorporated area of Marion County. Transportation <br />and Parks Systems Development Charges shall be assessed upon development of the <br />home on the newly created parcel, at the time of application for building permits. <br /> <br />17. <br /> <br />Construction of improvements on the property shall not block historical or naturally <br />occurring runoff from adjacent properties. Site grading shall not impact surrounding <br />properties in a negative manner. <br /> <br />PROCEDURE: The Marion County Subdivision and Partitioning Ordinance provides that <br />certain Partition applications be considered first by the County Planning Director. If there is any <br />doubt that the application conforms with adopted land use policies and regulations the Director <br />must condition or deny the application. Any interested person who disagrees with the Director's <br />decision may request that the application be considered by the Marion County Hearings Officer <br />after a public hearing. The applicant may also request a reconsideration (one time only and a fee <br />of $200) on the basis of new information subject to signing an extension of the 150 day time <br />limit for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying a $250.00 fee. Requests for <br />reconsideration, or consideration by the Hearings Officer, must be in writing (Appeal Form <br />available from the Planning Division) and be received in the Marion County Planning Division, <br /> <br /> <br />
