Marion County Surveyor's Office indicates that parcels 10 acres and less must be surveyed. <br />Per ORS 92.050, a Plat must be submitted for review along with required fees and a Plant <br />service report and/or title report. <br />Marion County Fire District No. 1 indicates that the proposal must meet their requirements <br />for fire hydrant and water flow per Oregon Fire Code. In addition, their requirements for <br />addressing and fire apparatus access must be satisfied. <br />All other contacted agencies either failed to comment, or stated no objection to the proposal, <br />at the time this report was written. <br />6. The following regulations apply when lot line adjustments and/or partitioning of land <br />regulated by the Subdivision and Partition Ordinance are proposed in a RS zone: <br />(a) Lot Area: The minimum lot area for a single family <br />dwelling in a subdivision approved after the effective date of the Ordinance, or a <br />mobile home on a mobile home subdivision lot approved after the effective date of <br />this ordinance, is 4,000 square feet when located within the Salem/Keizer Area <br />Urban Growth Boundary. In all other cases lots shall be a minimum of 6,000 square <br />feet. (See Chapter 27 for density limitations). <br />(b) Lot dimensions, single family: Except as provided in Section 26.800 for Planned <br />Developments, the average width of a lot shall be at least 60 feet; provided that <br />within the Salem/Keizer Urban Growth Boundary the average width of a lot shall be <br />at least 40 feet, and the average depth of a lot shall be at least 70 feet. <br />(c) Lot dimensions, other uses: The average width of a lot shall be at least 40 feet, and <br />the average depth of a lot shall be at least 80 feet, except as provided in Section <br />26.800 for Planned Developments. <br />The proposed lots exceed the 6,000 square foot minimum required for single family <br />dwellings. The proposed parcels are at least 40 feet wide and over 90 feet deep. The <br />standards in 6 (a), (b), and (c) are satisfied. <br />8. Although the proposed partition can satisfy the requirements for lot size and dimension in the <br />RS zone, the subject property is a lot in Woodleaf Estates Subdivision (SUB01-1), and is <br />subject to the conditions of approval for that subdivision. In SUB01-1, the applicant <br />proposed to divide 3.08 acres in 18 lots including an L-shaped (flag) lot in the location of the <br />smaller of proposed lots in this application. After conducting a public hearing the Marion <br />County Board of Commissioners (BOC) issued an order granting approval to subdivide the <br />subject property into 16 lots subject to meeting certain conditions. Condition of approval #8 <br />prohibits direct access onto Hollywood Drive for any dwelling in the subdivision and <br />condition #9 specifically required removal of the proposed flag lot. Since this proposal fails <br />to satisfy the conditions of approval in the BOC order approving the subdivision, this request <br />must be DENIED. <br />
