15.Parks systems development charges may be assessed upon <br />development of the property at time of application for <br />building permits. <br />PROCEDURE: <br /> The Marion County Zoning Ordinance provides that <br />Administrative Review applications be considered first by the <br />County Planning Director. If there is any doubt that the applica- <br />tion conforms with adopted land use policies and regulations the <br />Director must deny the application. Any interested person who dis- <br />agrees with the Director's decision may appeal the decision to the <br />Marion County Hearings Officer. The applicant may also request a <br />reconsideration (one time only and a fee of $200.00) on the basis <br />of new information subject to signing an extension of the 150 day <br />time limit for review of zoning applications. <br />A public hearing is held on appeals subject to the appellant paying <br />a $250.00 fee. Appeals must be in writing (Appeal Form available <br />from the Planning Division) and be received in the Marion County <br />Planning Division, 3150 Lancaster Dr. NE, Salem 97305 by 4:30 <br />MAY 22, 2000 <br />. <br />p.m. on Please note an appeal directly to the Land <br />Use Board of Appeals is not allowed under ORS 197.830. If you have <br />any question about this application or the decision please call <br />588-5038 or visit the County Planning Office at the above address. <br />MAY 23, 2000 <br />This decision is effective unless appealed. <br />FINDINGS AND CONCLUSIONS: <br /> The findings and conclusions on which <br />the Director based has decision are noted below. <br />1.The subject 19.89 acres is designated ‘Farm and Timber’ in the <br />Marion County Comprehensive Plan. The purpose of this <br />designation and the corresponding FT (FARM/TIMBER) zone is to <br />encourage the continuation of commercial agricultural and <br />forestry uses. <br />2.The property is located on the south side of Crooked Finger <br />Road, approximately 650 feet west of its intersection with <br />Jakes Lane. <br />3.Properties to the north across Crooked Finger Road are smaller <br />parcels, some of which are developed with residences. A <br />mixture of farm and forest parcels are located to the west. <br />Land in timber production is situated to the south while <br />agricultural activity is the predominant use to the east. The <br />surrounding area is all zoned FT. <br />4.Soil % of ParcelCu.Ft/Ac./Yr <br />McCully100 171 <br />5.Section 139.030 of the Marion County Rural Zoning Ordinance <br />(MCRZO) specifies that dwellings may be established in the FT <br /> <br />
