<br />NOTICE OF DECISION <br />ADMINISTRATIVE REVIEW CASE NO. 00-16 <br />APPLICATION: <br /> Application of Egan Gardens, Inc. for an Administrative Review to establish a <br />farm stand on a 19.45 acre parcel in an EFU (EXCLUSIVE FARM USE) zone on property located <br />at 9805 River Road N., Salem. (Section 07C; T6S; R2W). Lots 200, 300, 400, 700, 800. <br />DECISION: <br /> Notice is hereby given that the Planning Director for Marion County has determined <br />that the proposed farm stand is a permitted use in the EFU zone. <br /> APRIL 25, 2002 <br />EXPIRATION: <br /> This decision is valid only when exercised by two years from <br />the effective date of the decision) unless an extension is granted. The effective period of this <br />application may be extended for one year subject to approval of an extension. Request for an <br />extension must be submitted to the Planning Division prior to expiration of the approval. (Extension <br />form available from the Planning Division). <br />CONDITIONS: <br /> <br />1.The applicants shall obtain any permits, including subsurface sewage disposal, required by the <br />Marion County Building Inspection Division. <br />2.Operation of the farm stand shall continually comply with the standards in the Section <br />136.040 (A) of the Marion County Rural Ordinance. <br />3.The applicant shall be prepared upon request of the Marion County Planning Director to <br />provide evidence that incidental sales does not exceed 25% of the total sales of the farm <br />stand. <br />Other Permits, Fees and Restrictions: <br />The applicants are advised that the use of the property proposed in this application may require <br />additional permits and/or fees from other local, State or Federal agencies. The Marion County land <br />use review and approval process does not take the place of, or relieve the applicants of responsibility <br />for acquiring such other permits, or satisfying any restrictions or conditions thereon. <br />4.The applicant is advised to contact the Marion County Health Department to determine if any <br />permits are required. <br />PROCEDURE: <br /> The Marion County Zoning Ordinance provides that Administrative Review <br />applications be considered first by the County Planning Director. If there is any doubt that the <br />application conforms with adopted land use policies and regulations the Director must deny the <br />application. Any interested person who disagrees with the Director's decision may appeal the decision <br />to the Marion County Hearings Officer.
