zoned SA while properties to the south across Wintercreek Road
are in an EFU (EXCLUSIVE FARM USE) zone. These areas contain
a mixture of various-sized farm operations.
4.The applicants are proposing to replace an existing mobile
home with another residence.
5.Section 137.030(E) of the Marion County Rural Zoning Ordinance
allows the alteration, restoration, or replacement of a
dwelling subject to certain requirements. These include:
(a)The dwelling was lawfully established; and
(b)Has intact exterior walls and roof structure, and
(c)Has indoor plumbing consisting of a kitchen sink, toilet
and bathing facilities connected to a sanitary waste
disposal system; and
(d)Has interior wiring for interior lights; and
(e) Has a heating system; and
(f)In the case of replacement, the replaced dwelling is
removed, demolished or converted to an allowable non-
residential use within three months of occupancy of the
replacement dwelling.
6.A review of County Assessor’s records and aerial photographs
of the area indicate this existing mobile home was legally
placed on the subject property. Therefore, the criterion in
5(a) is satisfied.
7.Based on a site inspection, the existing dwelling has intact
exterior walls and roof structure. It also appears the
residence contains the necessary kitchen and bathroom facili-
ties. In addition, the dwelling has indoor electricity and a
heating system. The proposal meets the standards outlined in
5(b), 5(c), 5(d) and 5(e) above. The requirement identified
in 5(f) can be made a condition of any approval.
8.Based on the above discussion, Planning Division staff
concludes the existing dwelling was legally established and
may be altered, restored and/or replaced.
Craig O.
