zoned SA while properties to the south across Wintercreek Road <br />are in an EFU (EXCLUSIVE FARM USE) zone. These areas contain <br />a mixture of various-sized farm operations. <br />4.The applicants are proposing to replace an existing mobile <br />home with another residence. <br />5.Section 137.030(E) of the Marion County Rural Zoning Ordinance <br />allows the alteration, restoration, or replacement of a <br />dwelling subject to certain requirements. These include: <br />(a)The dwelling was lawfully established; and <br />(b)Has intact exterior walls and roof structure, and <br />(c)Has indoor plumbing consisting of a kitchen sink, toilet <br />and bathing facilities connected to a sanitary waste <br />disposal system; and <br />(d)Has interior wiring for interior lights; and <br />(e) Has a heating system; and <br />(f)In the case of replacement, the replaced dwelling is <br />removed, demolished or converted to an allowable non- <br />residential use within three months of occupancy of the <br />replacement dwelling. <br />6.A review of County Assessor’s records and aerial photographs <br />of the area indicate this existing mobile home was legally <br />placed on the subject property. Therefore, the criterion in <br />5(a) is satisfied. <br />7.Based on a site inspection, the existing dwelling has intact <br />exterior walls and roof structure. It also appears the <br />residence contains the necessary kitchen and bathroom facili- <br />ties. In addition, the dwelling has indoor electricity and a <br />heating system. The proposal meets the standards outlined in <br />5(b), 5(c), 5(d) and 5(e) above. The requirement identified <br />in 5(f) can be made a condition of any approval. <br />8.Based on the above discussion, Planning Division staff <br />concludes the existing dwelling was legally established and <br />may be altered, restored and/or replaced. <br />Craig O.
